On February 21, 2024, Nexus appealed the District Court for the Western District of Virginia’s order denying their motion for judgment on the pleadings. On February 21, 2024, Nexus appealed the District Court for the Western District of Virginia’s order denying their motion for judgment on the pleadings. They also appealed the District Court’s denial of certification of an interlocutory appeal. The 4th Circuit dismissed Nexus’ appeal because appellate courts may only exercise jurisdiction over the final orders or decisions of district courts, certain interlocutory appeals, and collateral orders. Nexus argued that the appeal on the motion for judgment on the pleadings should be considered an immediately appealable collateral order. A collateral order is one that does not terminate the litigation, but is sufficiently important that the court should see it as final and thus eligible for appellate consideration. The 4th Circuit considered three factors to hold that a district court’s dismissal order was not a collateral order. First, the dismissal of the motion for judgment on the pleadings did not conclusively determine the disputed question as the district court felt that discovery was necessary to properly adjudicate this case. Second, the order did not resolve an important issue completely separate from the merits. Because the initial motion for judgment on the pleadings is about the initial question of the case, this element is not satisfied. Third, the order would not be effectively unreviewable on appeal from a final judgment. Accordingly,, the 4th Circuit affirmed the district court.

 On March 31, 2024, the district court ruled in favor of the Plaintiffs. 2024 WL 1392568. The court held that the Plaintiffs had plausibly alleged that Nexus was a “covered person” under the CFPA because Nexus was a corporation that provided a financial product or service. Next, the court held that Nexus clearly engaged in deceptive practices. The court granted the full monetary relief the Plaintiffs requested, totaling 811 million dollars. The court also granted injunctive relief under both the CFPA and state laws in Massachusetts, Virginia, and New York. The award also included the appropriate legal aid or equitable relief to consumers, including restitution for costs the immigrant consumers incurred by entering into these contracts. Lastly, the award also included civil monetary penalties.

Nexus then appealed the final judgment to the 4th Circuit. On October 15, 2025, the 4th Circuit affirmed the lower court’s decision and remedies. 156 F.4th 443. Nexus appealed on four grounds. First, Nexus argued that the district court abused its discretion in approving sanctions for their series of violations of court orders and affronts to the court. Second, Nexus argued that the district court was required to approve their evidence at the remedies hearing, even though this evidence was not produced during discovery. Third, Nexus contended that the permanent injunctive relief did not comply with any applicable law. The Court of Appeals rejected all of these arguments. Lastly, Nexus argued that the district court erred in calculating the monetary award, and the 4th Circuit again affirmed the lower court.

As of February 5th, 2026, the case is not ongoing.
