This is case about health safety and racial discrimination involving the National Football League (NFL) and its players. This federal multidistrict litigation arose from four parallel actions: one in the U.S. District Court of the Eastern District of Pennsylvania and three in the U.S. District Court of the Central District of California. These cases were consolidated in the U.S. District Court for the Eastern District of Pennsylvania. The initial plaintiffs were former NFL players. However, the certified class came to consist of all living NFL players who were retired prior to class certification; their authorized representatives; and the players’ spouses, parents, or children of the players. The plaintiffs sued on twenty-eight different counts related to tortious misconduct and fraud on the part of the NFL. Plaintiffs sought a declaration of liability, injunctive relief, medical monitoring, and financial compensation for long-term chronic injuries and financial injuries suffered by the players due to mismanagement and misdiagnoses of mild traumatic brain injuries (MTBI) in the game. The case was assigned to Judge Anita B. Brody.

The defendants filed a motion to dismiss on August 30, 2012, but prior to the motion’s resolution and at the court’s direction, the parties began settlement negotiations on July 8, 2013. On August 29, 2013, the parties agreed to an initial settlement term sheet, and on June 25, 2014, the parties produced an initial class action settlement agreement. This settlement included provisions for the defendants to: provide payments to settlement class members, provided they met qualifying medical diagnoses, and establish an education fund to support education about player safety for youth football and medical effects for retired players. Monetary damages for each member of the class were to be tiered based on seasons played, age at the time of diagnosis, and various demographically-adjusted statistical data for cognitive abilities. Parties could opt out until October 14, 2014, to preserve their right to separately sue. Subsequent amendments tweaked aspects of the agreement at the behest of additional class members, with the final agreement coming on May 8, 2015. 2015 WL 12827803.

On January 7, 2017, the Third Circuit approved the District Court’s order, making the settlement effective.  As of October 2021, the NFL had paid out $800 million in settlement claims.

Also in early 2017, the parties developed a user manual (the "BAP Clinician’s Interpretation Guide") for the neuropsychologists administering medical diagnoses as part of the settlement. The BAP Clinician’s Interpretation Guide recommended, but did not require, clinicians to use full demographic corrections—which would include the use of racial norms—in administering neuropsychological testing.

On August 20, 2020, a former NFL player who was part of the settlement class filed an objection to the decision rendered to him, arguing that the decision had misconstrued the settlement agreement and deprived him of equal rights under the law in conflict with 42 U.S.C. § 1981 as a result of the use of Race Norms in the Settlement Program. The Court denied the Objection without prejudice on November 20, 2020, and Najeh Davenport filed a Motion for Reconsideration on December 3, 2020 that remains pending.

On August 25, 2020, Najeh Davenport and another Settlement Class Member, Kevin Henry, filed a Motion for Relief in in this litigation as intervenors, 12-md-2323 (E.D. Pa. Aug. 25, 2020), ECF No. 11169, asking the District Court to construe the Class Action Settlement Agreement so as to avoid racial discrimination, and a separate class action complaint against the NFL Parties, Henry et al. v. Nat’l Football League et al., 2:20-cv-04165 (E.D. Pa. Aug. 25, 2020), alleging that the Settlement Program is racially discriminatory and deprives them of equal rights on the basis of race, and purporting to assert a claim under 42 U.S.C. § 1981 for deprivation of equal rights under the law against the NFL Parties. On November 20, 2020, the District Court denied the Motion for Relief without prejudice because the Intervenors failed to exhaust their administrative remedies under the Class Action Settlement Agreement’s Settlement Claim process before petitioning the District Court. On November 24, 2020, the Intervenors appealed the District Court’s determination to the Third Circuit Court of Appeals in In re: Nat’l Football League Retired Players’ Concussion Injury Litigation, 20-3401 (3d Cir.). On July 26, 2021, the Third Circuit dismissed the Motion for Relief Appeal.

The NFL Parties filed a motion to dismiss the Complaint on November 2, 2020 on the ground that the lawsuit constituted an improper collateral attack on the Class Action Settlement Agreement, which the District Court granted on March 8, 2021, while noting its “concern[] about the race-norming issue.” The Intervenors appealed the District Court’s determination to the Third Circuit Court of Appeals, Henry v. Nat’l Football League, 21-1434 (3d Cir.) (the “Complaint Appeal”).

Pursuant to the March 8, 2021 order dismissing Intervenors’ case, the District Court referred the NFL Parties and Class Counsel to mediation, as supervised by Magistrate Judge David Strawbridge, to address the concerns relating to the potential use of Race Norms in connection with the Settlement Program (the “Mediation”). Intervenors filed a motion to intervene and, on April 8, 2021, the District Court entered an Order “[a]ppreciating that Henry and Davenport, through their counsel . . . had raised a very important issue— particularly in the context of the 65-year life of the [Class Action] Settlement Agreement. . . .” The Court “decided to take the unusual step of attempting to reach some understanding of how this issue might be amicably resolved outside an adversarial setting,” and directed Magistrate Judge Strawbridge to “comment upon the involvement of individuals beyond the NFL and Class Counsel” in the process. On June 3, 2021, the District Court granted the motion to intervene in part, noting that “intervention may facilitate the ongoing mediation process” because “Movants have presented research on the appropriate use of norms, and they may have information that would be useful to the mediation.” Since then, the NFL Parties, Class Counsel, and Intervenors have been working under the supervision of the Magistrate Judge in furtherance of the District Court’s March 8, 2021 order.

As of April 15, 2022, while the settlement order has been completed, the case remains ongoing with continuing mediation about replacing the race norms.
