On April 26, 2007, Disability Law Center Alaska (DLC Alaska) filed this lawsuit in the U.S. District Court for the District of Alaska against North Star Behavioral Health System (North Star), which operated an acute care facility. DLC Alaska alleged that North Star violated the Protection and Advocacy for Individuals with Mental Illness Act (PAIMI Act) when they refused to provide them with internal investigation records concerning a child who was allegedly abused at the facility. DLC Alaska sought injunctive relief to obtain the relevant records in question. Judge John W. Sedwick presided over this matter. 

This lawsuit began after DLC Alaska received a complaint of potential abuse at North Star from the child’s parent. North Star denied DLC Alaska’s request for all internal investigation records and supporting documents. North Star repeatedly denied this request, claiming that DLC Alaska could not request “peer review” records and that such peer review records were protected from disclosure under Alaska state law.

After filing suit, North Star filed a Motion to Compel Production of notes of interviews between the child in question, the child’s mother, and a DLC Alaska investigator. The court denied North Star’s motion, reasoning that these were privileged communications and that the PAIMI Act regulations required DLC Alaska keep these conversations confidential. On March 27, 2008, the court granted DLC Alaska’s Motion for Preliminary Injunction to receive the records in question. The court explained that, under Ninth Circuit precedent, peer review records like those in question here fell within the scope of PAIMI records access. Next, the court determined that the PAIMI Act preempted Alaska state law preventing the release of the peer review records. The court granted declaratory relief, finding that North Star violated the PAIMI Act. After the defendant's non-opposition to plaintiff's bill of costs, there is no further docket activity and the case is now closed.
