The plaintiffs brought this class action lawsuit in federal court on Aug. 5, 2020, because they and others similarly situated were at risk of becoming severely ill or dying from COVID-19 while being held at Patton State Hospital, one of the largest psychiatric hospitals in the country. Defendants held plaintiffs at this locked facility pursuant to involuntary psychiatric commitments.

The defendants, Stephanie Clendenin, Director of the California Department of State Hospitals and Janine Wallace, Director of Patton State Hospital were represented by the California Office of the Attorney General.  The five plaintiffs were represented by Disability Rights California, Covington & Burling, Davis Wright Tremaine, and Uber Technologies. Hon. Jesus Gilberto Bernal of the U.S. District Court, C.D., California presided over the case.

Plaintiffs’ compliant sought relief under two claims: 1) violations of the Due Process Clause of the Fourteenth Amendment, which requires Defendants to provide Plaintiffs with conditions of confinement and services necessary to ensure their reasonable safety, and 2) violations of Title II of the ADA which requires defendants to make disability-related reasonable modifications to protect plaintiffs and class members from COVID-19.

In their complaint, Plaintiffs sought the following relief: 1) That the court issue an injunction ordering Defendants to identify all members of the Conduct expedited individualized assessments of all members of the Class to effectuate their safe discharge or transfer from DSH-Patton to a safe, non-congregate setting; 2) take all necessary precautions to protect any class members who are not transferred or discharged from COVID-19 infection; 3) appoint an independent court-appointed monitor(s); 4) retain jurisdiction of this case until Defendants have fully complied with the orders of this Court; 5) attorneys’ fees and costs.  

As of the date of the filing, at least 112 patients and 147 facility staff at DSH-Patton had tested positive for COVID-19. At least two patients had died from complications after contracting the virus. Plaintiffs had conditions that, according to the CDC, made them highly vulnerable to severe illness or death if they were to contract COVID-19 and defendants had, per the complaint, taken no meaningful steps to modify their policies and procedures to facilitate the release or transfer of Plaintiffs and others similarly situated to safer settings.

The case proceeded slowly from August to December 2020 with the exchange of pleadings and the filing of appearances. On December 14, 2020, due to rapidly worsening infection conditions, plaintiffs filed two documents: 1) an ex parte application for Temporary Restraining Order; 2) ex parte application to certify the class. One factor in plaintiff’s decision to file was the increase of more than 100 cases in the two weeks prior to filing, including the infection of three of the five named Plaintiffs. A hearing on the request for a TRO was held on December 22, 2020.     

A series of regular status and scheduling conferences in Spring 2021 addressed infection, inoculation and death rates at the hospital. Decisions on the pending motions were stayed during this time.  Settlement negotiations also occurred, culminating in a final settlement on June 18, 2021.

The terms of the settlement were: Defendants would 1) offer vaccines to individuals in specific groups of patients that were previously unable to access them, 2) continue existing efforts with respect to social distancing, handwashing guidelines and mask wearing, 3) update its public website with data on infection rates through Dec. 31, 2021, 4) offer support to patients in the process of COVID- l9-based grieving and bereavement.

This Settlement stated that it would terminate on December 31, 2021. Until then, it specified that any action to enforce its terms "must be filed in Los Angeles County Superior Court or Sacramento County
Superior Court."

The agreement included a stipulation of dismissal of the federal lawsuit, ending the case.
