On April 23, 2020, plaintiff, a 60-year old deaf man whose primary language is American Sign Language (ASL) filed a complaint against CSL Plasma, alleging he asked for an ASL interpreter to translate the registration materials from English into ASL. Plaintiff claimed defendant did not provide an ASL interpreter or any other way for plaintiff to understand the registration materials and thus he was denied the opportunity to donate plasma and obtain payment. The complaint, filed by Equip for Equality, alleges these failures violated Title III of the ADA and Illinois Human Rights Law.  The case was filed in U.S. District Court for the Northern District of Illinois and assigned to the Honorable Mary M. Rowland and to Magistrate Judge, the Honorable Sunil R. Harjani.

On April 21, 2021, plaintiff moved for partial summary judgment. On July 14, 2021, the United States of America filed a statement of interest in support of the plaintiff.

Before the motion was resolved, the parties reached a settlement and on November 3, 2021, the case was dismissed. Though the complete agreement isn't publicly available, the docket indicates that the court retains jurisdiction to enforce its terms.

MINUTE entry before the Honorable Mary M. Rowland: The State of Illinois's unopposed motion for reassignment 17 18 is granted. The two cases are related because they share numerous issues of fact and law, and they request similar forms of relief. Reassignment is appropriate as both cases are pending in this district, the handling of these cases by the same judge will save considerable judicial resources, and the earlier case has not progressed to the point where designating a later filed case as related would substantially delay proceedings in the earlier case. The Court accordingly finds that all Local Rule 40.4(b) conditions of reassignment are met. The case captioned State of Illinois v. CSL Plasma, Inc. & CSL Behring, LLC, No. 20 C 3535 is reassigned to this Court for all purposes. Defendant's responsive pleading remains due on 9/24/20, and the deadline to file a joint initial status report remains 10/23/20. Mailed notice. (dm, ) (Entered: 08/24/2020)
