On Aug. 6, 2019, Plaintiffs Christopher Meyer, Sarah Meyer, and the National Federation of the Blind, Inc. filed suit in the U.S. District Court for the Southern District Of Indiana.  The suit alleged systemic violations of the civil rights of blind Indiana residents that denied them equally effective access to all print and website communications created or distributed by Defendants and their contractors concerning government benefits. 

Plaintiffs alleged that these communications violated Title II of the Americans with Disabilities Act of 1990 (“ADA”) and Section 504 of the Rehabilitation Act (“Section 504”). Specifically, the complaint cited communications related to the application, eligibility, receipt, and administration of HIP (Medicaid), SNAP, and other state benefit programs, stating that defendants and their contractors provided such communications only in standard print and on inaccessible websites. The suit named as defendants Jennifer Walthall, in her official capacity as Secretary of The Indiana Family and Social Services Administration, and Adrienne Shields, in her official capacity as Director of The Indiana Division of Family Resources. 

Plaintiffs were represented by Indiana Protection and Advocacy Service, Brown, Goldstein & Levy, LLP and the Law Office of Jana Eisinger, PLLC. Defendants were represented by the Indiana Attorney General’s Office. 

Plaintiffs sought declaratory and injunctive relief and attorney fees. They requested a permanent injunction prohibiting Defendants from violating Title II of the ADA and Section 504, and requiring Defendants to ensure that Plaintiffs have equally effective access to all information Defendants provide to Indiana residents. Specifically, plaintiffs requested equal access to all print communications in appropriately secure formats that are accessible to blind users; remediation of state websites so that they provide equally effective communication to blind users; and the  implementation of policy changes to ensure the consistent and affirmative provision of alternative formats to blind individuals going forward.

The case was assigned to the Honorable Judge Jane Magnus-Stinson who set a trial date of April 19, 2021.  The parties appeared on May 21, 2020 for a status conference to address three discovery disputes, which the court resolved. On Oct. 6, 2020, Plaintiffs filed a Motion for Summary Judgment and Defendants replied with a cross motion on Nov. 4, 2020.  On March 25, 2021, the court denied the Motion for Summary Judgment and set the following issues as remaining for trial: 1) Whether Plaintiffs' claims were moot because of Defendants' remedial actions; 2) Whether Defendants' print communications violate Title II of the ADA and Section 504; and 3)  Whether Defendants' websites violate Title II and Section 504.

The parties appeared on June 18, 2021, and informed the court that they had settled the case; the contents of the settlement do not appear in the docket. The case was dismissed with prejudice by Judge Jane Magnus-Stinson on 8/31/2021.
