On December 15, 2015, several individuals with disabilities, the Access Center for Independent Living, and National Federation of the Blind of Ohio filed suit in the U.S. District Court for the Southern District of Ohio against Dayton Mall and several retailers in the mall (hereafter referred to as the Mall defendants) under Title III of the Americans with Disabilities Act (ADA). Judge Thomas M. Rose presided over this matter.

For decades, the defendants had a policy and practice of allowing all seven Greater Dayton Regional Transit Authority (RTA) bus routes serving the mall area to stop immediately adjacent to a mall entrance, providing easy access to the mall for all patrons, including individuals with disabilities. In 2003, the defendants required the bus stop to be moved 600 feet away from the mall entrance, on the other side of a parking lot without crosswalks or other protective measures from traffic and limited the bus routes allowed on mall property from seven to four. After years of passengers and advocacy groups unsuccessfully seeking a more accessible bus stop and restoration of the lost routes, plaintiffs filed this suit.

On February 26, 2016, the Mall defendants filed a motion to dismiss for failure to state a claim, which was overruled without prejudice.

On August 18, 2016, the plaintiffs filed an amended complaint, adding the RTA as defendant because the relief sought required the continued cooperation of the RTA.

On December 18, 2017, the Mall defendants filed a motion for summary judgement, which was granted on Jun 8, 2018, with the judge determining plaintiffs had not come forward with evidence from which a reasonable juror could find they are unable to access the mall via the current bus stop and even if they cannot use the fixed route bus system, paratransit is provided by RTA, thus plaintiff’s requested modification is not necessary under the ADA. The case is now closed.
