This case involves the payment of subminimum wages to three individuals with disabilities under the Fair Labor Standards Act (“FLSA”). Represented by Disability Rights Ohio, the National Federation for the Blind and private counsel, the three plaintiffs with disabilities successfully challenged their employer’s, Seneca Re-Ad Industries, Inc. (“Seneca Re-Ad”), payment of subminimum wages in an administrative proceeding. Seneca Re-Ad then sought judicial review of those proceedings in another, related action, arguing in part that a claim for liquated damages under the FLSA must be brought in court, and cannot be brought in an administrative proceeding. To preserve their right to seek all relief they may be entitled to under the FLSA and Ohio law, the plaintiffs filed this action in the U.S. District Court for the Northern District of Ohio. Judge Jeffrey J. Helmick presided.

Seneca Re-Ad filed a motion to dismiss for failure to state a claim upon which relief may be granted on December 7, 2017, which the plaintiffs opposed and moved to stay proceedings until the related administrative process had run its course. The judge granted plaintiff’s request for a stay on February 19, 2019, noting the final resolution of the administrative proceedings before the Department of Labor could impact factual and legal disputers in this case, so a stay would protect the parties from prejudice and further interests of judicial economy and efficiency. On April 12, 2024, the plaintiffs filed their notice of dismissal with prejudice in this case, as the related case, the appeal of the administrative proceedings (3:20-cv-2325), had settled. The judge ordered this case dismissed and it is now closed.
