This is a case about a P&A’s monitoring authority. On September 18, 2006, Oregon Advocacy Center, Oregon’s Protection & Advocacy (P&A) agency, filed this lawsuit against Scar/Jasper Mountain (Scar), a school for children with mental illness, in the U.S. District Court for the District Court of Oregon. Represented by itself, Oregon Advocacy Center alleged that the school violated the Protection and Advocacy for Individuals With Mental Illness Act (PAIMI Act) when they barred the P&A from conducting monitoring visits. Judge Thomas M. Coffin presided over this matter. 

This dispute arose after Scar refused to let Oregon Advocacy Center conduct monitoring at the school. Scar said that their monitoring requests were not reasonable and against the best interests of students. In December 13, 2006, the court permanently enjoined Scar from denying Oregon Advocacy Center’s ability to monitor under its PAIMI Act authority. The parties agreed on stipulations that set the contours of the P&A’s monitoring authority. Oregon Advocacy Center had to provide Scar with twenty-four hours notice before monitoring, staff would alert children of Oregon Advocacy’s presence and role, and Scar would notify all parents and guardians that Oregon Advocacy Center may monitor the school. The case closed in December 13, 2006.
