This is a case about the scope of a Protection and Advocacy agency’s (P&A) facilities access and investigations authority. This is a case about the scope of a Protection and Advocacy agency’s (P&A) facilities access and investigations authority. On July 12, 2007, Disability Law Center (DLC), Utah’s P&A, filed this lawsuit in the U.S. District Court for the District of Utah. DLC filed this lawsuit against Discovery Academy, a therapeutic boarding school under the Protection and Advocacy for Individuals with Mental Illness Act (PAIMI Act). Represented by itself and private counsel, Disability Law Center sought declarative and injunctive relief that the PAIMI Act required Discovery Academy provide them with all records requested for an investigation into their restraint policies and other allegations of abuse, as well as facilities access for monitoring. Judge Clark Waddoups presided over this matter.

In June 2005, DLC learned that a resident at Discovery Academy was manually restrained and secluded. DLC began an investigation and interviewed the resident. Following this interview, DLC believed that other students were subject to abuse or neglect, and sought records of the initial resident’s treatment and incident records, facility-wide restraint records for the preceding six months, and general facilities access for monitoring. Discovery Academy provided DLC with restraint records for the initial resident and the Academy’s general restraint practices, but would not provide additional information or facilities access. On January 5, 2010, the court granted Discovery Academy’s Motion for Summary Judgement. The court explained that a P&A may only investigate a facility where they provide the facility with a complaint or factual basis for probable cause of abuse or neglect, that the abuse or neglect is ongoing, and that the individual is PAIMI eligible. Here, the court reasoned that DLC had no basis for its investigation because the student that triggered the investigation no longer resided at the facility and they did not provide a complaint or probable cause that other Discovery Academy students experienced abuse or neglect. The court stated these limitations ensured that P&A investigations do not violate the Fourth Amendment of the U.S. Constitution. On January 6, 2010, the court dismissed Disability Law Center’s claim with prejudice and closed the case.
