This lawsuit challenged Indiana abortion restrictions banning the use of telehealth for dispensing abortion medication and requiring physicians to disclose misleading information to patients about the potential to reverse medical abortions. On May 18, 2021, a coalition of medical clinics and physicians filed a complaint in the U.S. District Court for the Southern District of Indiana. The plaintiffs sued Indiana state officials, including the attorney general of Indiana, in their official capacities under 42 U.S.C. § 1983. Represented by attorneys from Planned Parenthood and the ACLU, the plaintiffs sought injunctive and declaratory relief. 

The challenged legislation included several restrictions. First, the telehealth ban and the in-person dispensing and consumption provision required physicians to prescribe abortion medication during in-person appointments and be physically present while patients consumed the medication. Second, the required-disclosure provision forced physicians to give patients misleading information as part of the informed-consent process. Medical abortions involve taking two pills about 24 to 48 hours apart, and the required-disclosure provision required physicians to tell their patients that “[s]ome evidence suggests” the effects of the first pill can be reversed with medical intervention if the second pill has not yet been taken. Indiana intended the challenged abortion legislation to take effect on July 21, 2021.

The plaintiffs claimed that the required-disclosure provision violated the free speech clause of the First Amendment and that both the required-disclosure provision and the ban on the use of telemedicine to prescribe and dispense abortion medication violated the due process and equal protection clauses of the Fourteenth Amendment. The case was assigned to Judge James Patrick Hanlon and Magistrate Judge Mark J. Dinsmore.

The court granted the plaintiffs’ request to defer consideration of the telehealth ban and in-person dispensing and consumption requirement until the court issued a holding on related abortion restrictions in Whole Woman’s Health Alliance v. Rokita (1:18-cv-01904). On August 10, 2021, the Rokita court permanently enjoined Indiana from enforcing the related abortion restrictions. 2021 WL 3508211. However, the Seventh Circuit subsequently stayed the injunction pending appeal. Whole Woman’s Health All. v. Rokita, 13 F.4th 595 (7th Cir. 2021). That case is still ongoing.

On June 14, 2021, Indiana opposed the plaintiffs’ motion for a preliminary injunction regarding the required-disclosure provision. The court then held an evidentiary hearing on the plaintiffs’ motion a week later. Judge Hanlon granted the plaintiffs’ motion for a preliminary injunction and enjoined Indiana from enforcing the required-disclosure law on June 30, 2021. Judge Hanlon held that the plaintiffs showed a reasonable likelihood of success on the merits, because the required-disclosure law forced physicians to give patients misleading information in violation of the First Amendment. The information was misleading because there was a lack of medical evidence to support the theory that medical abortions can be reversed after the first pill, and no randomized, controlled studies had been conducted.

Indiana filed an answer to the complaint on July 12, 2021. As of February 3, 2022, the parties were engaged in discovery and the case was ongoing.
