On August 31, 2020, the ACLU, Planned Parenthood, and the Center for Reproductive Rights, on behalf of abortion providers in Tennessee, challenged what they alleged was a medically unsound “abortion reversal” state law. They sued the Commissioner of the Tennessee Department …

On August 31, 2020, the ACLU, Planned Parenthood, and the Center for Reproductive Rights, on behalf of abortion providers in Tennessee, challenged what they alleged was a medically unsound “abortion reversal” state law. The providers brought this lawsuit under 42 U.S.C. § 1983, alleging that the law violated their First Amendment right against compelled speech and Fourteenth Amendment rights to equal protection and substantive due process. They sued the Commissioner of the Tennessee Department of Health, the Chair of the Board for Licensing Health Care Facilities, the President of the Tennessee Board of Medical Examiners, and the District Attorneys for several counties and cities. Plaintiffs sought an injunction preventing enforcement of the law and a declaration that the law violated the Constitution; they also sought costs and attorney's fees. The case was assigned to Judge William L. Campbell in the U.S. District Court for the Middle District of Tennessee.

The state statute in question was Section 39-15-218 of H.B. 2263/S.B. 2196, which was scheduled to take effect on October 1, 2020. Plaintiffs in this case claimed that the Act required abortion providers, upon threat of criminal prosecution and other sanctions, to advise patients that medication abortion may be reversible. However, the plaintiffs claimed that no credible evidence suggested that a medication abortion could be reversed. A handful of doctors had begun experimenting with a method for achieving this, but according to the complaint, the method remained untested and not medically accepted. Unless the court agreed to enjoin the law, plaintiffs claimed that it would immediately result in irreparable harm by: (1) damaging the trust between physicians and patients; (2) misleading patients when making life-altering health decisions; and (3) exposing patients to scientifically unsupported, potentially harmful, medical advice.

The plaintiffs moved for short-term injunctive relief on September 1, 2020, and Judge Campbell granted a temporary restraining order on September 29, 2020, just two days before the law took effect. 2020 WL 5797984. Though the arguments had focused on the content of the message with respect to the procedure's reversibility, Judge Campbell postponed ruling on that issue in light of conflicting expert testimony. Instead, he held that the abortion providers were likely to succeed because the law also required abortion providers to inform patients that information would be available on the Department of Health website, but because of a built-in delays provided for by the statute, that information might not be available for up to 90 days following enactment. A patient wishing to access such information would be unable to do so in violation of the law itself. The court also held that the abortion providers would suffer irreparable harm if a TRO were not issued due to the criminal penalties providers would be subject to in the event that they refused to issue the message.

On February 26, 2021, Judge Campbell granted the abortion providers' request for a preliminary injunction. 523 F.Supp.3d 985. The court found that plaintiffs were likely to succeed on the merits of their First Amendment claim because the message abortion providers were required to give their patients about a treatment that might reverse a medication abortion was misleading since: (1) the research was unreliable; (2) the message misled patients by suggesting that the procedure, unalterable in all likelihood, was reversible; and (3) the message inappropriately suggested that "reversal" was safer and more effective than science suggested.

The parties jointly moved to stay the case on January 28, 2022 until 60 days after the U.S. Supreme Court issued its opinion in Dobbs v. Jackson Women's Health Organization, a pending significant challenge to reproductive rights that could impact the outcome of this litigation. The court granted this motion.

In August 2022, after the Supreme Court issued its opinion in Dobbs, the parties jointly moved to lift the stay and dismiss the case, noting that the issues in the case were moot because the decision triggered Tennessee’s abortion ban. The trial court granted the parties’ joint stipulation to dismiss the case without prejudice on September 22, 2022. Each party bore its own costs, fees, and expenses. This case is closed.
