This case concerns an ordinance passed in March 2019 by Mt. Juliet, Tennessee, which modified zoning restrictions and effectively prohibiting surgical abortion clinics from being located within the city. The ordinance limited the location of abortion clinics to certain zones and prohibited abortion clinics from being located within 1000 feet of any church, school, college, home, park, public library, or child care center. As a result, there was no suitable land in Mt. Juliet for a surgical abortion clinic under the modified zoning rules. The city passed the ordinance days after Carafem, a nonprofit organization that offers women's reproductive health services, opened and announced that in addition to providing medication abortions it would begin providing surgical abortions. 

On December 18, 2019, on behalf of Carafem, the ACLU, ACLU of Tennessee, and private counsel filed this suit against the city of Mt. Juliet under 42 U.S.C. § 1983 in the U.S. District Court for the Middle District of Tennessee. The plaintiff sought declaratory and injunctive relief arguing that the City's ordinance violated the Fourteenth Amendment's  Equal Protection Clause and both the Due Process Clause of the Fourteenth Amendment and the Tennessee Constitution. They alleged that the ordinance did not protect the health, safety, or welfare of Mt. Juliet citizens, served no legitimate governmental purpose, and unduly burdened Tennesseean's access to abortion. The case was assigned to Judge Eli J. Richardson. The plaintiff also filed a motion for preliminary injunction when it brought this case.

The case was referred to Magistrate Judge Alistair Newbern on December 19.

In January 2020, before responding to the plaintiff's pleadings, the defendants introduced and passed an amendment to the ordinance. The amended ordinance reduced the distance restriction 1000 feet to 200 feet. The amendment changed how the distance was measured so that some areas now complied with the distance restriction, and it included language explaining that the purpose of the new zoning restriction was to "promot[e] the health, safety and welfare of not only those seeking to utilize the services of a surgical abortion clinic but also to preserve the City’s economic growth and shift protests to a less densely populated area."

In response to the amended ordinance, the plaintiff filed an amended complaint on February 13, 2020. They asserted that although amendment appeared to loosen the zoning restrictions, the ordinance still prevented Carafem from performing surgical abortions at its facility. The plaintiff continued to argue that the amendment did not overcome the fact that the original ordinance was enacted for the sole purpose of blocking constitutional access to abortion. They claimed that defendant failed to identify any legitimate, compelling reason for the ordinance — the defendant failed to provide support for the purported justifications identified in the amendment. On the same day, in conjunction with their amended complaint, the plaintiff amended their motion for preliminary injunction accordingly.

On February 26, 2020, the defendants filed an answer to the plaintiff's amended complaint and a counterclaim. Regarding their counterclaim, the defendants contended that surgical abortions were not within the definition of professional medical services in the City's zoning regulations and they sought declaratory judgment that the plaintiff was not entitled to provide surgical abortions.

The parties engaged in discovery until, on May 1, 2020, Judge Richardson issued a preliminary injunction that blocked the city's zoning ordinance. Judge Richardson wrote that it was a substantial likelihood that the ordinance violated substantive due process and the City likely enacted the ordinance with the purpose of placing a substantial obstacle in the way of women asserting their constitutional rights seeking abortions in Mt. Juliet. 

The litigation continued until, in response to the preliminary injunction, the defendants voluntarily repealed the ordinance in its entirety. On September 10, 2020, the parties settled the case. The defendants were prohibited from enacting the ordinance or anything substantially similar for one year. The court issued a declaratory judgment stating that the defendants recognized Carafem's right to perform surgical abortions and that Carafem could open facilities anywhere in the city where medical services were permitted. The defendants' counterclaim was also resolved when they repealed their ordinance and settled with the plaintiff. The defendants also paid $225,000 in attorneys' fees and expenses to the plaintiff's private counsel. The case is now closed.

ORDER GRANTING AMENDED MOTION FOR A PRELIMINARY INJUNCTION: For the reasons discussed in the accompanying Memorandum Opinion, which is incorporated herein by reference, the Court GRANTS Plaintiff FemHealth USA, Inc. d/b/a carafem's Amended Motion for Preliminary Injunction (Doc. No. 37 ), which seeks a preliminary injunction with respect to two zoning regulations of the City of Mt. Juliet, namely, Ordinance 2019-16 (the "Ordinance") and Ordinance 2020-8 (the "Amendment"). IT IS THEREFORE ORDERED that Defendants, as well as their agents, employees, and successors in office, are HEREBY ENJOINED, pending final judgment, from enforcing or threatening to enforce the Ordinance or the Amendment against Plaintiff. IT IS FURTHER ORDERED, for good cause shown and absent objection from Defendants, that the bond requirement of Fed. R. Civ.
