On July 30, 2019, Planned Parenthood of the St. Louis Region and a licensed obstetrician-gynecologist brought this suit in the U.S. District Court for the Western District of Missouri, challenging Missouri laws that would ban abortion in the state at nearly every stage of pregnancy. The plaintiffs, represented by the ACLU, sued the Governor of Missouri, the state Attorney General, the Circuit Attorney for the City of St. Louis, the President of the State Medical Board, and the Director of the Department of Health and Senior Services, which licenses abortion facilities.

The plaintiffs challenged H.B. 126, a state law that banned abortion at or after eight weeks of pregnancy. The law also provided that abortion be banned at 14, 18, and 20 weeks of pregnancy. The law contained a severability provision that stated that if any one of these bans was to be found unenforceable, unconstitutional, or invalid, that the balance of the statute would remain effective. The only exception included in the bill was for medical emergency. The law also included a "reason ban," which prohibited abortion at any stage of the pregnancy, if the provider found that the reason for the abortion was based on a prenatal indication of Down Syndrome or based on the sex or race of the embryo or fetus. The plaintiffs alleged that since each ban would prohibit abortion prior to viability, the bans violated the Due Process Clause of the Fourteenth Amendment. The plaintiffs sought declaratory judgment and an injunction prohibiting enforcement of the law. The case was assigned to Judge Howard F. Sachs.

On the same day the complaint was filed, the plaintiffs moved for a preliminary injunction. On August 19, 2019, the defendants moved to dismiss the case, arguing that the plaintiffs failed to state a claim for which relief could be granted and that they lacked standing. On August 27, 2019, the court granted in part the plaintiffs' motion for preliminary injunction. 389 F. Supp. 3d 631. The court found that the plaintiffs were likely to succeed on their challenge to the reason ban based on the Supreme Court's holding in Planned Parenthood of Southeastern Pennsylvania v. Casey that "the State's interests are not strong enough to support a prohibition of abortion or the imposition of a substantial obstacle to the woman's effective right to elect the procedure" before viability. 

The court also found that the plaintiffs were likely to succeed on their challenge to the 8, 14, 18 and 20 week bans, since all of these bans took effect before viability. This finding was also based on the Supreme Court's ruling in Casey, as well as prior federal court cases striking down 20-week limits. The court next turned to the threat of irreparable harm to the plaintiffs, the balance of harm to the parties if preliminary relief were to be granted, the public interest, and the preservation of the status quo. The court found that the bill's 8-week ban would prohibit more than two-thirds of Planned Parenthood’s patients from obtaining abortions and would prohibit about half of all Missouri abortions. The 20-week rule, on the other hand, would only prohibit around 100 abortions each year and the reason ban would prohibit an unknown number of abortions. The court found that the public interest, based on the plaintiffs' likelihood of success, favored the plaintiffs. Taking all of this into consideration, the court prohibited enforcement of all of the bans except the anti-discriminatory reason ban. The court decided against enjoining the reason ban, finding that the challenge to the sex- and race-based decision ban was moot based on the plaintiffs' lack of knowledge of any such abortions at their facilities and lack of ability to predict future such abortions. Regarding the ban on "Down Syndrome abortions," the court found that the plaintiffs had not shown a likelihood that the ban would interfere with the abortion rights of women during the timeframe of the litigation.

On August 29, 2019, the defendants appealed the district court's preliminary injunction order to the U.S. Court of Appeals for the Eighth Circuit (USCA Case Number 19-2882). On the same day, the defendants also moved the district court to stay the preliminary injunction pending appeal. On September 4, 2019, the plaintiffs moved for reconsideration of the district court's preliminary injunction order regarding the reason ban.

On September 18, 2019, the district court denied the defendants’ motion to stay the preliminary injunction pending appeal. 2019 WL 4457658. While the defendants argued that abortion providers lacked standing to sue for third-party protection of abortion rights, the court found that both the Supreme Court of the United States and the Eighth Circuit had previously determined that abortion providers had standing in several similar cases, while defendants had never successfully challenged standing under similar circumstances in any federal court. The court again emphasized the likelihood of success by the plaintiffs because of Supreme Court precedent protecting the right of women to make the decision whether to abort a non-viable fetus.

On September 27, 2019, the district court issued a supplemental order to the earlier preliminary injunction order. 408 F. Supp. 3d 1049. The court reanalyzed the Down Syndrome ban and noted the possibility that without an injunctive protection in place, it was foreseeable that the ban could affect an abortion patient during the ongoing litigation. The court stated that, in this event, the patient and provider would need to seek a temporary restraining order, which would likely be granted. The court therefore decided to extend the injunctive relief to the reason ban as it related to Down Syndrome diagnoses. On September 30, 2019, the defendants appealed the court's supplemental order to the Eighth Circuit and moved for a stay pending the appeal (USCA Case No. 19-3134). The court denied the request for stay on October 1, 2019. The Eighth Circuit also declined to stay any of the injunctive relief pending appeal on October 2, 2019.

On October 8, 2019, Judge Sachs recused himself from the case for reasons unknown to the Clearinghouse. The case was reassigned to Chief Judge Beth Phillips for further proceedings.

On June 9, 2021, the Eighth Circuit affirmed the district court's injunction. 1 F.4th 552. A three-judge panel agreed with the district court that the plaintiffs had standing to sue, finding that the timing-based bans and the reason ban put abortion providers at risk of civil and criminal sanctions, which gave them personal stake to establish standing under Article III of the U.S. Constitution. In addition, the panel noted that abortion providers had standing to sue on behalf of their patients.

Next, the Eighth Circuit panel analyzed the factors for the granting of a preliminary injunction. The panel again agreed with the district court, finding that the plaintiffs were likely to succeed on the merits, that the threat of irreparable harm to the plaintiffs was present, and that the balance of hardships and the public interest weighed in favor of the plaintiffs. While the court agreed with the defendants that federal courts should be cautious before delaying the effect of state laws, the court found that Missouri had failed to demonstrate that its policy priorities outweighed the public interest in access to pre-viability abortions or the harm to pregnant individuals who may seek a pre-viability abortion before the final resolution of the case. The court therefore found no error in the district court's injunction against the enforcement of the time-based bans or the Down Syndrome ban.

On July 7, 2021, the defendants filed a petition for a writ of certiorari.

On July 13, 2021, the Eighth Circuit granted rehearing of the case en banc and vacated the June 9, 2021 opinion. On October 4, 2021, the Supreme Court denied the petition for a writ of certiorari, since the Eighth Circuit had withdrawn its prior opinion. 

On June 24, 2022, the plaintiffs requested a voluntary dismissal of the action in light of the Supreme Court’s decision in Dobbs v. Jackson Whole Women’s Health, which overruled Roe v. Wade and Planned Parenthood v. Casey and eliminated the constitutional right to abortion. The court dismissed the case without prejudice on July 13, 2022.
