Two abortion providers, Planned Parenthood of Arkansas and Eastern Oklahoma and Little Rock Family Planning Services, filed this lawsuit in the U.S. District Court for the Eastern District of Arkansas on June 20, 2017, where it was assigned to Judge James Moody. The plaintiffs sought to enjoin the Arkansas Department of Health from enforcing a provision of a state law known as Act 383 that required the Arkansas Department of Health to revoke the licenses of any abortion-providing medical facili…

Two abortion providers, Planned Parenthood of Arkansas and Eastern Oklahoma and Little Rock Family Planning Services, filed this lawsuit in the U.S. District Court for the Eastern District of Arkansas on June 20, 2017, where it was assigned to Judge James Moody. The plaintiffs sought to enjoin the Arkansas Department of Health from enforcing a provision of a state law known as Act 383 that required the Arkansas Department of Health to revoke the licenses of any abortion-providing medical facilities found in "violation of any provision or rule of law." This provision, known as the Mandatory Suspension or Revocation Provision (the Provision), was scheduled to go into effect on July 30, 2017.

The plaintiffs specifically alleged that the Provision violated their rights under the Equal Protection and Due Process Clauses of the Fourteenth Amendment, as well those rights of their patients, by infringing upon the patients' rights to privacy and liberty. In filing their suit, the plaintiffs sought declaratory relief, attorneys' fees, and permanent injunctive relief to prevent the Arkansas Department of Health from enforcing the Provision. 

On July 3, 2017, the plaintiffs filed a motion for summary judgment, but it was never decided. Nearly a year later, on May 14, 2018, the plaintiffs filed a motion for a protective order, likely to conceal any private information about patients that was included in the suit. The court denied this motion without prejudice on June 19, 2018.

The Arkansas Department of Health then filed a motion on August 16, 2018, to dismiss one of the claims, which was unopposed. This claim alleged that the Provision violated abortion patients' due process rights to privacy and liberty by infringing on their right to choose an abortion. 

On April 3, 2019, the plaintiffs filed a motion to dismiss the case without prejudice because the law had not been enforced, according to the ACLU. The court granted the motion on April 8, 2019, and the case is now closed.
