Planned Parenthood of South Atlantic (PPSA), Greenville Women’s Clinic (GWC), and an individual abortion provider on behalf of himself and his patients brought this civil rights action under 42 U.S.C. § 1983 to challenge the constitutionality of the South Carolina Fetal Heartbeat Protection from Abortion Act (hereinafter “SB 1” or “the Act”), which banned abortion after the detection of fetal or embryonic cardiac activity. This moment can occur as early as approximately the sixth week of pregnancy, as dated from the first day of a pregnant person’s last menstrual period (“LMP”). The plaintiffs were represented by the Center for Reproductive Rights and the Planned Parenthood Federation of America.

On February 18, 2021, Governor Henry McMaster signed the SC Fetal Heartbeat Protection from Abortion Act. The Act provided that “no person shall perform, induce, or attempt to perform or induce an abortion” where the “fetal heartbeat has been detected.” It defined “fetal heartbeat” to include any “cardiac activity, or the steady and repetitive rhythmic contraction of the fetal heart, within the gestational sac.” Adopting this definition of the fetal heartbeat effectively barred some women from getting an abortion as soon as the sixth week of pregnancy, even though South Carolina law established a legal presumption that “viability occurs no sooner than the twenty-fourth week of pregnancy.” The Act also included new ultrasound, mandatory disclosure, record-keeping, reporting, and written notice requirements that were closely intertwined with the operation of the prohibition on abortion after the detection of cardiac activity. Though the Act did carve out certain exceptions—including for pregnancies resulting from rape and incest—the Act would require medical providers to report such cases to the local sheriff regardless of a patient’s desire.

The plaintiffs filed suit on February 21, 2021, in the U.S. District Court for the District of South Carolina against the Attorney General of South Carolina and various state officials from the South Carolina Department of Health and Board of Medical Examiners in their official capacity. The plaintiffs filed an amended complaint on March 10, 2021, which reflected that the state law in question had since gone into effect. The plaintiffs sought declaratory relief stating that SB 1 violated the Fourteenth Amendment right to Due Process, injunctive relief preventing the enforcement of SB 1, and attorneys’ fees. The case was assigned to District Judge Mary Geiger Lewis. Though not initially named as a defendant, Governor McMaster intervened and later filed a motion to dismiss that was denied.

On February 19, 2021, Judge Lewis issued a temporary restraining order (TRO) preventing the enforcement of SB 1 until March 5, 2021. 520 F.Supp.3d 823. That TRO was later extended until March 19, 2021. On March 19, 2021, Judge Lewis granted the plaintiffs’ motion for preliminary injunction, preventing enforcement of SB 1 until the court reached a final decision in the case. The court held that the plaintiffs had standing to challenge the Act, had established a substantial likelihood of success on the merits, and would be irreparably injured absent an injunction. The court reasoned that SB1 clearly violated the principle established by the Supreme Court in Planned Parenthood v. Casey guaranteeing the right to abortion pre-viability. The court also found that the balance of equities favored the plaintiffs and that injunctive relief was in the public interest. 527 F. Supp. 3d 801. 

On April 2, 2021, the defendants filed an interlocutory appeal to the U.S. Court of Appeals for the Fourth Circuit challenging the preliminary injunction. They argued that the plaintiffs did not have standing to bring suit and that the district court erred by enjoining the entirety of the Act and not severing the 6-week abortion ban. On July 13, 2021, the district court stayed the case pending the Supreme Court’s resolution of Dobbs v. Jackson Women’s Health

The Fourth Circuit heard oral argument on January 27, 2022. On February 22, 2022, the court of appeals issued an opinion written by Judge Stephanie D. Thacker affirming the district court's preliminary injunction. Relying on Supreme Court precedent, the Fourth Circuit panel held that abortion providers have standing to assert their patients’ rights and to challenge regulations or legislation that operate directly against them. The court of appeals further held that the district court did not abuse its discretion in determining that the provisions of the Act were not severable. 26 F.4th 600.  

On June 24, 2022, the Supreme Court issued its decision in Dobbs v. Jackson Women’s Health Organization, overturning Roe v. Wade and eliminating the constitutional right to abortion. That same day, the defendants moved to stay the preliminary injunction and the plaintiffs moved to voluntarily dismiss their suit in light of Dobbs. On the same day, the plaintiffs moved to expedite consideration of their dismissal motion so that they could preserve their option to challenge the abortion ban under any remaining federal or state claims available to them. 

On June 27, 2022, the court granted both motions. 2022 WL 2314508. That same day, the defendants moved for summary judgment arguing that the plaintiffs' sole legal claim had no foundation because there was no longer a constitutional right to abortion. 

On July 21, 2022, the appellate court vacated its earlier opinion and the district court's preliminary injunction, and remanded the case to the district court. 2022 WL 2900658. On July 22, 2022, the court granted the plaintiffs' motion to dismiss, lifted the stay, vacated the preliminary injunction, and denied all remaining motions as moot. 2022 WL 2905496.
