This is a case about the constitutionality of a Wisconsin statute requiring physicians who perform abortions to have admitting privileges in a hospital within 30 miles of where the abortion is performed. On July 5, 2013, Planned Parenthood of Wisconsin, Milwaukee Women's Medical Services, and two board-certified medical doctors at Planned Parenthood filed this lawsuit in the U.S. District Court for the Western District of Wisconsin. The plaintiffs sued the Wisconsin attorney general, the Dane County district attorney, Wisconsin Medical Examining Board members, and the Wisconsin Secretary of the Department of Safety and Professional Services under the Fourteenth Amendment of the United States Constitution. Represented by Planned Parenthood, the ACLU, and private counsel, the plaintiffs sought injunctive and declaratory relief. They claimed that the disputed statute would make abortion unavailable in Wisconsin after 19 weeks of pregnancy, leave all areas north of Madison without an abortion provider, and severely restrict the availability of abortions in the remainder of the state. The case was assigned to Judge William M. Conley.

With their complaint, the plaintiffs also filed two motions: a motion for a temporary restraining order and preliminary injunction to prevent enforcement of the statute, and a motion to certify a defendant class comprised of the Wisconsin's 71 district attorneys. The court granted the temporary restraining order on July 8, 2013, 963 F. Supp. 2d 858, and the preliminary injunction on August 2, 2013. 94 F. Supp. 3d 949. The court granted class certification on July 17, 2013.

The defendants filed a motion to dismiss on July 29, 2013. The court denied the motion on January 6, 2014.

On August 6, 2013, the defendants filed a notice of appeal to the U.S. Court of Appeals for the Seventh Circuit seeking review of the court's entry of a preliminary injunction and a motion to stay all proceedings pending appeal. On August 15, 2013, the district court granted in part and denied in part the defendants' motion to stay proceedings, striking all scheduled dates but allowing the parties to engage in discovery while this case was on appeal. The Seventh Circuit affirmed the district court's preliminary injunction on December 20, 2013. 738 F.3d 786. The defendants tried to appeal, but the U.S. Supreme Court declined to hear the case. The district court lifted the stay on January 6, 2014. 

The plaintiffs filed a motion for summary judgment on February 28, 2014, which the court denied on May 23, 2014. 23 F. Supp. 3d 956. The parties proceeded to a bench trial before Judge Conley, which was carried out on May 27-30, 2014.

On March 25, 2015, the court entered a judgment in the plaintiffs' favor, declaring the disputed statute unconstitutional under the Fourteenth Amendment of the U.S. Constitution and enjoining the defendants from enforcing it. The judgment awarded the plaintiffs attorneys' costs and fees, with the amount to be determined through the parties' future filings. 94 F. Supp. 3d 949.

The defendants filed a notice of appeal in the U.S. Court of Appeals for the Seventh Circuit on April 6, 2015. The Seventh Circuit affirmed the district court's judgment with costs on December 15, 2015. 806 F.3d 908. The defendants once again tried to appeal, but the U.S. Supreme Court again declined to hear the case.

In July 2016, the plaintiffs filed documentation supporting their attorneys' fees and other litigation costs. The parties ultimately reached a settlement on the amount, and the defendants filed a joint stipulation as to costs and fees on September 7, 2016. The next day, the court accepted that stipulation and entered an amended judgment, ordering the defendants to pay the settlement amount of $1.6 million. 

The case is now closed.

** TEXT ONLY ORDER **On July 8, 2013, the court issued a temporary restraining order enjoining defendants from "enforcing the hospital admitting privileges requirement for abortions performed at PPW's Appleton-North and Milwaukee-Jackson centers and AMS's centers until July 18, 2013." (Dkt. 21 ) This order was extended on July 17, 2013, after full briefing and hearing, until the court issued an opinion and order on the preliminary injunction motion "or August 1, 2013, whichever is later." (Dkt. 61 ) The language of this most recent order was unfortunate in two respects: (1) the "extension of the TRO" should have been more accurately characterized as the issuance of an interim preliminary injunction pursuant to Fed. R. Civ. P. 65(a), see Sampson v. Murray, 415 U.S. 61, 87 (1974) ("[A] temporary restraining order continued beyond the time permissible under Rule 65 must be treated as a preliminary injunction....); and (2) the court's reference to August 1, 2013, has the unintended consequence of creating uncertainty about the preliminary injunction's force beginning on August 1st. Although the court anticipates issuing its written decision on the motion for preliminary injunction by week's end, to avoid any misunderstanding, IT IS ORDERED THAT the preliminary injunction issued on July 17, 2013, is extended until August 8, 2013, or issuance of the court's decision, whichever is later.
