In 2013, Indiana made two changes to its state laws regulating abortion clinics. These amendments changed the definition of “abortion clinic” to include not only clinics which provide surgical abortions, but also clinics which provided abortion-inducing medicine. They also imposed new regulations on any clinic which fell under the new definition of “abortion clinic,” requiring that all abortion clinics meet standards only necessary for facilities which conducted surgical abortions. The new definition of “abortion clinic” exempted hospitals and physician’s offices, even if those entities provided abortion-inducing medicine. These amendments, which went into effect on July 1, 2013, appeared to target Planned Parenthood of Indiana and Kentucky’s (PPINK’s) Lafayette clinic. The Lafayette clinic was the only clinic which fell under the new definition of abortion clinic and therefore had to meet facility requirements intended for surgical facilities. Complying with these requirements would require extensive remodeling of the Lafayette clinic. Finally, a separate amended section of code revoked the option to apply for a waiver to these new regulations. 

On August 22, 2013, PPINK filed this lawsuit in the United States District Court, Southern District of Indiana, where the case was assigned to District Judge Jane Magnus-Stinson. PPINK sued the Indiana Department of Health and Indiana Attorney General under 42 U.S.C. § 1983. Represented by the ACLU and PPINK’s in-house counsel, PPINK sought preliminary and permanent injunctive relief, declaratory relief, and attorney’s fees. PPINK argued that the statutory regulations were arbitrary and irrational regulation of medicine in violation of women’s 14th Amendment right to privacy. It also argued that the regulations were irrational and arbitrary and therefore violated PPINK’s rights to substantive due process and equal protection under the 14th Amendment. Finally, it asserted that to the extent that the statutory amendments precluded abortion clinics from receiving waivers, that the amendments further violated the equal protection clause of the 14th Amendment. 

On August 27, 2013, five days after filing the complaint, the plaintiff filed a motion for a preliminary injunction against the defendants. On November 26, 2013, Judge Magnus-Stinson released an order granting in part and denying in part PPINK’s motion. She found that PPINK was likely to prevail on the claim that the amended statute’s distinguishing an abortion clinic from a physician’s office violated PPINK’s Equal Protection rights because it arbitrarily treated the PPINK Lafayette Clinic differently from a “physician’s office” even though both offices could be categorized as facilities for which abortion medication makes up less than a majority of their services. Denying the motion for a preliminary injunction in part, the judge found that PPINK was not likely to prevail on its claim against the portion of statute that exempted abortion clinics from receiving waivers because there was sufficient legal precedent to support the fact that abortion clinics and physician offices can be regulated differently.

On April 30, 2014, five months after the preliminary injunction, the plaintiffs moved for summary judgment and the defendants filed a cross motion a month later. There was a hearing of oral argument for these cross-motions for summary judgment on October 30, 2014 then on December 3, 2014, the judge released her findings based on this oral argument. 

Judge Magnus-Stinson’s order on the parties’ cross-motions for summary judgment granted in part PPINK’s motion for summary judgment. Judge Magnus-Stinson relied on the same reasoning from the preliminary judgment order for the portion of amended statute that distinguished non-surgical abortion clinics from physician’s office. The judge also reversed her finding in the preliminary judgment stage on the portion of statute that exempted abortion clinics from waivers. She granted summary judgment for PPINK because the amended statute singled out abortion clinics as the only facility which could not apply for waivers to the requirements made by the new regulations, and that this therefore also violated the Equal Protection Clause of the 14th Amendment. However, the Court declined to find in favor of PPINK’s Fourteenth Amendment claim brought on behalf of its patients’ right to choose an abortion or on PPINK’s substantive due process claim because there was enough competing evidence that resolution of each claim through summary judgment was not possible. The defendant’s motion for summary judgment was denied in all respects. 

In this order, the judge also declined to issue final judgment because PPINK’s claim for injunctive relief regarding the portion of Indiana Code that Indiana had amended to extend new facility requirements was still pending, although summary judgment in favor of the Equal Protection claim entitled PPINK to relief. On January 6, 2015, Judge Magnus-Stinson granted the plaintiff’s motion to enforce the findings of the summary judgment order and a permanent injunction and final judgment were entered. The state did not appeal and the parties eventually reached a settlement on attorneys’ fees and costs. 

After final judgment, Indiana repealed the challenged statutes. On June 16, 2015, the defendants made a Rule 60(b)(5) motion for relief from judgment because Indiana’s Statutory Code no longer contained the unconstitutional language. PPINK opposed this motion claiming Rule 60(b)(6) “may not be used to challenge the legal conclusions on which a prior judgment or order rests.” On July 2, 2015 Judge Magnus-Stinson released an order which added a clarification that the permanent injunction and final judgment from January 6, 2015 have no effect on the portions of Indiana Code implicated in the initial lawsuit as Indiana had amended them to read, but ultimately denied the defendant’s motion for relief from judgment. The state did not appeal and the case remains closed.

ORDER: Because the IDOH has not yet acted on PPINK's application or waiver requests, there is currently no indication whether PPINK's Lafayette clinic will be considered an "abortion clinic" on January 1, 2014, I.C. § 16-18-2-1.5(a), such that it would be subject to the surgical-related physical plant requirements that it contends it does not currently meet. But this uncertainty is not due to delay on PPINK's part, considering that it filed its application and waiver requests within two weeks of the effective dates of the challenged statutes. PPINK's application and waiver requests have been pending before the IDOH for almost four months, and it is undisputed that the challenged statutes modify the definition and regulation of what is an "abortion clinic" in a way that could impact PPINK's Lafayette clinic in approximately seven weeks. Given this time frame, the Court ORDERS the State to file a report by November 13, 2013, detailing the status of PPINK's abortion clinic application and waiver requests, why those requests have not yet been ruled on, the average amount of time it has taken the IDOH to rule on similar requests, and when the IDOH anticipates ruling on PPINK's pending requests ***SEE ORDER FOR ADDITIONAL INFORMATION***.
