Case Summary

On July 19, 2018, the Center For Reproductive Rights and the National Women’s Law Center filed a complaint in U.S. District Court for the District of Columbia. The plaintiffs sued the U.S. Department of Health and Human Services (HHS) under the Freedom of Information Act (FOIA). Represented by Covington and Burling LLP, the plaintiffs asked the court to compel HHS to disclose records responsive to two FOIA requests, which sought records pertaining to certain complaints filed with the HHS Office…

On July 19, 2018, the Center For Reproductive Rights and the National Women’s Law Center filed a complaint in U.S. District Court for the District of Columbia. The plaintiffs sued the U.S. Department of Health and Human Services (HHS) under the Freedom of Information Act (FOIA). Represented by Covington and Burling LLP, the plaintiffs asked the court to compel HHS to disclose records responsive to two FOIA requests, which sought records pertaining to certain complaints filed with the HHS Office for Civil Rights. Judge Beryl A. Howell presided over the case.

On September 12, 2018, following a joint status report, Judge Howell quickly ordered the parties to continue to file such reports, updating the court on HHS’s efforts locating and sharing potentially responsive documents. The bulk of the docket consists of these status reports, which the parties filed periodically throughout the litigation. Reports were filed through August 13, 2021.

On November 5, 2018, the Operations and Resources Division of the HHS Office of Civil Rights informed the plaintiffs that they had located 130 pages of responsive documents but that those documents were exempt from release because they pertained to open investigations. The parties agreed that other documents that had been located by other divisions within the HHS Office of Civil Rights would be released on a rolling basis. 

In an attempt to resolve the exemption issue through summary judgment, the plaintiffs filed a motion for a scheduling order on June 4, 2019. On July 8, the Court ordered HHS to provide the plaintiffs with a detailed description of the withheld documents and a justification for withholding them (otherwise known as a Vaughn index). In response to the Vaughn index, the plaintiffs abandoned their motion and pursued a private agreement concerning these documents.

On October 8, 2021, the parties stipulated to a dismissal, and the court dismissed the case without prejudice four days later.  The stipulation of dismissal did not explain the reasons for the dismissal. As of the last status report filed before dismissal, the Civil Rights Division had developed an ongoing project to identify potentially responsive documents, and the Conscience and Religious Freedom Division had produced 17,123 pages of responsive documents, 7,712 of which had been partially or fully disclosed.

This case is now closed.
