Three people formerly incarcerated at Challenger Memorial Youth Center, a juvenile detention center in Lancaster, California, brought a purported class action on January 12, 2010, in the United States District Court for the Central District of California to challenge the educational services provided at Challenger. The plaintiffs alleged that Challenger provided constitutionally inadequate educational services to incarcerated youths.  The plaintiffs originally brought claims under 42 U.S.C. § 1983 and state law. Represented by the ACLU of Southern California, the plaintiffs sought injunctive and declatory relief, compensatory services, monetary damages, and attorneys costs and fees. The case was assigned to Judge George H. King.

The parties agreed to have a multidisciplinary team of experts visit Challenger to make recommendations, and the team issued its recommendations on July 20, 2010. The district court stayed the case while the parties engaged in settlement negotations. On February 10, 2011, the plaintiffs amended their complaint to add a claim under the Individuals with Disabilities Act, 20 U.S.C. § 1400. The amended complaint also narrowed the purported class definition from all persons incarcerated at Challenger to "[a]ll youth who were detained at Challenger Memorial Youth Center at any point between January 12, 2008 and November 8, 2010."

The parties reached a settlement agreement, filed under seal, which was approved by the Court on May 23, 2011. The settlement agreement required defendants to make systemic reforms at Challenger to ensure the provision of appropriate educational services in the future. It also required the Los Angeles County Office of Education to provide compensatory educational services to class members. Finally, the agreement awarded $10,000 in compensatory damages to one of the named plaintiffs and $350,000 in attorneys' fees. The parties filed six subsequent semiannual joint status reports to monitor compliance with the settlement agreement. The court awarded additional attorneys' fees totaling $140,000 associated with preparing those reports.

The case is now closed.

Defendant Los Angeles County of Probation is directed to mail revised class notices to the 831 class members whose original class notices were returned due to invalid addresses, as well as to the California Department of Corrections and Los Angeles County jail. These revised notices must be mailed no later than May 6, 2011. The revised notice will read exactly the same as the original notice to the class, with the exception being that the deadline for opt outs and objections will be changed, only for these 831 class members and any class members currently detained at the CaliforniaDepartment of Corrections and Los Angeles County jail, from May 6, 2011 toMay 18, 2011. 2.
