The Civil Rights Division of the United States Department of Justice (DOJ) brought this suit on February 24, 2022 against Pennsylvania's judicial system in the US District Court for the Eastern District of Pennsylvania in the courtroom of District Judge Mitchell S. The Civil Rights Division of the United States Department of Justice (DOJ) brought this suit on February 24, 2022 against Pennsylvania's judicial system in the US District Court for the Eastern District of Pennsylvania in the courtroom of District Judge Mitchell S. Goldberg. DOJ alleged that the defendant had violated the Americans with Disabilities Act (ADA) by discriminating against individuals with opioid use disorder (OUD) in its court supervision programs. According to the DOJ, the Pennsylvania judicial system prohibited or limited the use of OUD medication by individuals in “treatment court” programs providing court supervision. OUD medication helps diminish the effects of physical dependency and/or prevent cravings. The alleged policy, according to the DOJ, violated Title II of the American with Disabilities Act. The DOJ requested the court to declare that the alleged policy violated the ADA, enjoin its continued use, and update its policy and train its employees on the new policy. The DOJ also sought compensatory damages and an order requiring the Pennsylvania judicial system to appoint an employee to monitor efforts to bring the policy in compliance with the ADA.

The Pennsylvania judicial system filed a motion to dismiss the complaint, which the court subsequently granted. 2023 WL 3044592. The court found the following issues with the DOJ’s complaint:

  1. A Northumberland County judge’s alleged decision to stop OUD medication from being administered to one complainant was a result of the judge’s individual discretion and not a blanket policy of the Pennsylvania judicial system. Therefore, the Pennsylvania judicial system could not be held responsible because it could not have interfered with the judge’s decision.
  2. The administrative order that blocked OUD medication in Jefferson County was rescinded in 2018. The court found that there was no immediate threat of future injury, so there was no basis for injunctive relief.
  3. For the remaining six counties cited in the DOJ’s complaint (Allegheny, Blair, Butler, Clinton, Delaware, and York), no individual was cited as suffering from the counties’ policies. Because the ADA only allows suit when a specific individual is harmed, the allegations against these counties were too vague.

On May 22, 2023 the DOJ filed an amended complaint which made the following changes:

  1. The DOJ specifically alleged that the Pennsylvania Judicial System "implement[ed] and fail[ed] to prevent the implementation of administrative policies and practices" that prevented access to OUD medication.
  2. DOJ named the Supreme Court of Pennsylvania as a defendant, and alleged that it failed to provide sufficient oversight over county courts to ensure that they weren’t violating the ADA, despite being aware of the problem.
  3. DOJ also named the individual County Courts of Common Pleas as defendants.
  4. The amended complaint more specifically noted each offending county’s policies and included additional individual complainants that allegedly suffered from the defendant counties' policies. 

The defendants moved to dismiss the amended complaint a few months later, on August 31. One month after that, the DOJ told the court that it was in settlement negotiations with the defendants. The settlement agreement was finalized, and the DOJ’s claim was officially dismissed in early February 2024. 

The settlement agreement stipulated the following:

  1. The defendants will refrain from discriminating against individuals with disabilities, including denying them the right to participate in and benefit from “aids, benefits, services, or programs.”
  2. Several defendant counties would adopt a policy that other counties will be encouraged to adopt. The policy states that courts will not prohibit someone from taking their prescribed medicine to treat substance use disorder. It also bars courts from mandating one medication over another, interfering with a licensed prescriber’s medical decisions on treatment, or discriminating against people who take OUD medication in eligibility for Problem-Solving Court or other court programs.
  3. Judges and other court officials will receive training about ADA compliance and OUD medication.
  4. The defendants will submit reports on their compliance. 
  5. The defendants will pay a total of $100,000 in damages to the aggrieved individuals.

The settlement agreement stated that the case would be dismissed, but could be reinstated if there was a dispute over compliance. The agreement was set to expire after two years.

As of October 2024, there have been no further judicial proceedings in this case since February 2, 2024.
