This is a case about Florida imposing voting restrictions on vote-by-mail procedures following the 2020 election. On May 6, 2021, the League of Women Voters, the Black Voters Matter Fund, the Florida Alliance for Retired Americans, and three individual plaintiffs filed this lawsuit in the Northern District of Florida. The plaintiffs sued the Florida Secretary of State and Attorney General, as well as the Supervisors of Elections for each of Florida’s 67 counties under the First and Fourteenth Amendments of the U.S. Constitution. Represented by private counsel, the plaintiffs sought injunctive and declaratory relief that Florida’s new voting restrictions were unlawful. They claimed that the restrictions—reducing access to vote-by-mail drop boxes, banning volunteers from assisting voters with returning their ballots, restricting who could give food and water to voters waiting in line, and requiring those registering people to vote to recite an allegedly misleading warning designed to dissuade potential voters from registering—imposed unconstitutional undue burdens on individuals’ free speech rights and right to vote. Upon filing, the case was assigned to Chief Judge Mark E. Walker.

Shortly after filing, the Republican National Convention and the National Republican Senatorial Committee sought to intervene in the lawsuit and in early June 2021, Judge Walker granted their motion to intervene. 2021 WL 5278735. In mid-June, on motion from the defendants, Judge Walker consolidated two other cases challenging Florida’s voting restrictions (Florida State Conference Of Branches and Youth Units Of the NAACP v. Lee, 4:21-cv-00187, and Harriett Tubman Freedom Fighters Corp. v. Lee, 4:21-cv-00242) for discovery purposes.

The parties proceeded to discovery, and in late June 2021, the Florida Secretary of State filed a motion to dismiss the lawsuit. The following month, 66 of 67 Supervisors of Elections requested to be excused from active participation in the lawsuit and the Florida Attorney General also filed a motion to dismiss the lawsuit. After the plaintiffs filed an amended complaint on July 16, Judge Walker denied the defendants’ pending motions as moot and allowed the lawsuit to proceed. The Secretary of State and Attorney General re-filed motions to dismiss on July 30, 2021.

On October 8, 2021, Judge Walker granted in part and denied in part the defendants’ motions to dismiss, allowing the lawsuit to proceed with respect to only certain provisions of the challenged law against certain defendants. Judge Walker reasoned that, although the plaintiffs had shown that they had suffered the requisite harm to continue their claims as to drop box restrictions, requiring all voters to make new requests for vote-by-mail ballots every general election cycle, prohibiting voters in line from interacting with third parties, and dissuasive mail-in-ballot application warnings, they were not fairly traceable to all defendants. 566 F.Supp.3d 1238. The court dismissed count II, challenging the volunteer assistance ban, for lack of standing. It also dismissed a number of counts against the individual defendants for lack of standing.

In late October, the plaintiffs moved for leave to file a second amended complaint. Judge Walker denied the motion, reasoning that it came after the court’s designated discovery deadline without any compelling reason for the delay in filing. Judge Walker indicated that the plaintiffs revealed no new facts that would permit a motion to amend past the deadline issued by the court, which lapsed on the day plaintiffs filed their motion.

In mid-November 2021, following the conclusion of discovery, the parties filed opposing summary judgment motions. In early December, Judge Walker consolidated this case and three others for trial (Florida State Conference Of Branches and Youth Units Of the NAACP v. Lee, 4:21-cv-00187; Harriett Tubman Freedom Fighters Corp. v. Lee, 4:21-cv-00242; and Florida Rising Together v. Lee, 4:21-cv-00201). On December 17, 2021, Judge Walker granted in part and denied in part the defendants’ motion for summary judgment, and denied the plaintiffs’ opposing motion. The ruling allowed the lawsuit to proceed to trial on all claims except the plaintiffs’ facial challenge to the non-solicitation provision under the First Amendment. Judge Walker granted the defendants’ motion as to the facial challenge, explaining that whether the distribution of food and water is an expressive activity protected by the First Amendment is to be decided in an as-applied challenge. 576 F.Supp.3d 1004.

The case proceeded to a 14-day bench trial before Judge Walker beginning on January 31 and concluding on February 16, 2022. Following the bench trial, on March 31, 2022, Judge Walker issued a declaration that the provisions of the Florida law challenged at trial—including the ballot drop box restrictions, the prohibition against third-party contact in voting lines, the requirement that new vote-by-mail applications be submitted each general election, and the registration disclaimer—were unconstitutional and a permanent injunction prohibiting their enforcement. 595 F.Supp.3d 1042.

Following Judge Walker’s judgment, the defendants appealed. The case remains ongoing.
