On February 3, 2021, the state of Arizona and the Arizona Attorney General filed suit in the United States District Court for the District of Arizona, challenging the Department of Homeland Security's (DHS's) January 20, 2021 memorandum which ordered almost all deportations halted for 100 days. The plaintiffs sued DHS, the DHS secretary, the commissioner of U.S. Customs and Border Protection, the Acting Director of U.S. Immigration and Customs Enforcement, and the Acting Director of U.S. Citizenship and Immigration Services. The case was initially assigned to Judge Douglas L. Rayes. Judge Rayes recused himself on February 4, 2021, and the case was randomly reassigned to Judge Eileen S. Willett. The case was reassigned again the next day to Judge Susan R. Bolton, and the case has remained with her since.

The plaintiffs initially asserted four claims to challenge DHS's memorandum. First, they alleged that DHS failed to consult Arizona as it was required to do by an agreement entered into by DHS and Arizona at the end of the Trump administration on January 8, 2021. Second, the plaintiffs claimed that the memorandum violated 8 U.S.C. § 1231, which requires the Attorney General to remove individuals ordered removed within 90 days of such order. Third, the plaintiffs asserted that DHS failed to follow required APA notice-and-comment procedures in issuing the memorandum. Fourth, they asserted that the memorandum was substantively arbitrary and capricious. The plaintiffs sought declaratory relief, an injunction postponing effect of the memorandum, and litigation costs. On March 8, 2021, the plaintiffs amended their complaint to add Montana as a plaintiff. The plaintiffs also added a fifth claim that the agency action was pretextual.

On May 6, 2021, the defendants moved to dismiss the complaint. On June 30, 2021, the Court granted the motion to dismiss on the alternative bases that the case was moot and that the memorandum was not reviewable under the Administrative Procedure Act. The plaintiffs appealed the dismissal to the Ninth Circuit on July 2, 2021 and moved for an injunction pending appeal. On July 30, 2021, the Ninth Circuit denied the motion for an injunction pending appeal. The appeal of the motion to dismiss is still pending.
