This is a putative class action lawsuit about the Mississippi Department of Correction’s (MDOC) alleged failure to provide adequate a) medical healthcare b) mental healthcare and c) accommodations to those with disabilities. 

On August 9, 2021, thirty offenders who were in the custody of MDOC and Disability Rights Mississippi, the designated protection and advocacy agency in the state, filed this lawsuit in the U.S. District Court for the Southern District of Mississippi. The plaintiffs sued MDOC, Vitalcore Health Strategies LLC, and XYZ Corporations under Title II of the Americans with Disabilities Act, Section 504 of the Rehabilitation Act, and 42 U.S.C. § 1983 for alleged violations of the Eighth, First Amendment, and Fourteenth Amendments. 

Represented by Disability Rights Mississippi, the plaintiffs sought: a declaration that the defendants had violated their rights under the Eighth Amendment; preliminary and permanent injunctive relief; an order requiring MDOC to create a plan to eliminate the substantial risk of serious harm; and attorney’s fees and costs. The case was assigned to Judge F. Keith Ball. 

As of June 15, 2022, this case is ongoing.
