Case Summary

On March 31, 2020, a deaf man in the custody of the Tennessee Department of Correction (TDOC) and Disability Rights Tennessee (DRT), the state protection and advocacy entity, filed this lawsuit in the U.S. District Court for the Middle District of Tennessee. The case was assigned to District Judge Aleta A. Trauger. On May 7, 2020, TDOC filed a motion to dismiss for lack of jurisdiction. After the parties engaged in motion practice on the motion to dismiss, plaintiffs moved for leave to file an amended complaint on July 13, 2020, proposing additional individual plaintiffs. Plaintiffs then filed a motion for preliminary injunction on October 14, 2020.

Judge Trauger issued an order addressing TDOC's motion to dismiss and plaintiffs' motion for leave to file an amended complaint on November 12, 2020. TDOC's motion was granted in part and denied in part and the plaintiffs' motion was granted. Specifically, the court held that the original individual plaintiff's claims could not be dismissed as untimely because the complaint sufficiently pled continuing harm. The court also found that DRT had associational standing to challenge TDOC's policies because of its role as the state protection and advocacy organization. 2020 WL 6685557.

On May 5, 2021, Judge Trauger granted plaintiffs' motion for a preliminary injunction. The court rejected TDOC's argument that plaintiffs had failed to exhaust administrative remedies prior to filing suit. On the merits, Judge Trauger found that plaintiffs were likely to succeed because they had presented sufficient evidence that their requested accommodations were reasonable. The court concluded that plaintiffs had shown a sufficient likelihood of irreparable harm because TDOC had not made sufficiently expeditious progress on accommodating plaintiffs. While the court concluded that plaintiffs had carried the burden of establishing that preliminary relief was appropriate, it did not find that plaintiffs were entitled to the relief they had requested. Instead, the court ordered that the plaintiffs work with TDOC to develop an interim plan for improving videophone access until the overhaul of accessible telecommunications in TDOC facilities. If TDOC could not agree to such a plan, it would be required to adequately document why such accommodations would not be reasonable. 2021 WL 10366330.

Following the granting of the preliminary injunction, the parties began discovery. On April 4, 2022, plaintiffs filed another amended complaint in which they added additional individual plaintiffs, and, on May 26, 2023, they filed a further amended complaint with supplemental facts that had occurred since the prior complaint was filed.

On August 29, 2023, the plaintiffs filed a second motion for a preliminary injunction, though they subsequently withdrew the motion in February 2024 because the named plaintiff then had access to a videophone, and the remaining issues in the motion had been subsumed by the plaintiffs' November 15, 2023, motion for partial summary judgment. They requested judgment that TDOC's failure to adequately assess individuals and failure to provide sufficient and reliable access to ASL interpreters and videophones violated both the ADA and Section 504 of the Rehabilitation Act. On the same day, TDOC filed a motion for summary judgment.

The plaintiffs filed a motion to bifurcate on January 25, 2024, which was subsequently denied by the court on February 16, 2024.

On July 9, 2024, the court granted in part and denied in part both parties' summary judgment motions. The court granted summary judgment in favor of plaintiffs on their claims that TDOC's failure to provide interpreters and videophones violated ADA and Section 504 of the Rehabilitation Act, and also granted their motion to exclude one of TDOC's proposed expert witnesses under the Daubert standard, finding the proposed witness not sufficiently qualified regarding ADA accommodations. Judge Trauger further found that DRT had standing as to the TDOC policies that had injured their identified constituents, that certain of plaintiffs' claims were timely because the kinds of violations alleged were considered "continuing violations," and that DRT was not required to exhaust administrative remedies under the Prison Litigation Reform Act (though PLRA did bar some of the individual plaintiffs' claims). The court granted summary judgment to defendants on hearing aid-related claims, ruling that those claims were untimely. The court further ruled in favor of defendants in determining that money damages were not available under the ADA in most cases, that emotional distress damages were not available under Section 504, and in dismissing the claims of two named plaintiffs. 739 F.Supp.3d 663.

On September 24, 2024, plaintiffs filed a motion for Permanent Injunction or Interlocutory Injunction. However, on October 29, 2024, the court denied plaintiffs’ motion because the facts relied upon in the request were largely disputed by Defendant.

On March 4, 2025, plaintiffs informed the court that they had reached a settlement agreement with TDOC to resolve all remaining claims. The agreement required TDOC to provide appropriate auxiliary aids and services, as well as reasonable accommodations, to enable deaf prisoners the ability to participate in and benefit from TDOC services, programs, and activities. Accommodations included qualified sign language interpreters for crucial interactions like intake and orientation, medical and mental health appointments, and discipline and parole-related proceedings, as well as videophones at every facility housing a deaf person. TDOC also agreed to screen all people in its custody for hearing loss and need for audiological examination, and to conduct individualized accommodation needs assessments to ensure effective communication and access to services. The order also prohibited TDOC from punishing or penalizing deaf inmates for their hearing disability or its expression (e.g., using sign language to communicate).

The agreement was set to continue for a term of two years, terminating on March 4, 2027. The parties agreed to administratively close the case, with the understanding that the court would retain jurisdiction over enforcement issues. The agreement also provided that TDOC would pay damages to three named individuals, as well as reasonable attorneys’ fees and costs, totaling $3,250,000.

On March 5, 2025, the case was administratively closed and is now in the enforcement stage.
