Seven individuals who protested in Minneapolis following the death of George Floyd filed this putative class action lawsuit in the United States District Court for the District of Minnesota on August 6, 2020. The plaintiffs–represented by private counsel–sued the City of Minneapolis, the Minneapolis Police Department (“MPD”), MPD Chief Medaria Arradondo, and individual police officers. They requested declaratory and injunctive relief for violations of their First, Fourth, and Fourteenth Amendment rights under 42 U.S.C. § 1983. The plaintiffs also sought to represent two putative classes: (1) all peaceful protestors subjected to excessive force by the MPD during the George Floyd protests, and (2) all persons who had ever been subjected to excessive force by the MPD.

The case was assigned to Judge Susan Richard Nelson. The defendants moved to dismiss on October 13, 2020, arguing that the complaint failed to state a claim, that the plaintiffs lacked standing, and that individual capacity claims against Chief Arradondo were not well pleaded. Judge Nelson granted the defendants’ motion in part on March 11, 2021. She concluded that the plaintiffs had not plausibly alleged that Chief Arradondo directly authorized the use of force against them, nor had they plausibly alleged facts supporting a supervisory liability claim against Chief Arradondo. Judge Nelson otherwise denied the defendants’ motion to dismiss.

The plaintiffs moved to consolidate this case with two other related cases on June 16, 2021. On August 21, 2021, Judge Nelson granted the motion with respect to one of the two cases: Armstrong v. City of Minneapolis, in which the plaintiffs sought to represent a class very similar to the putative classes in Samaha. On April 11, 2022, Robert Kroll moved to dismiss the case. Kroll was president of the Minneapolis Police Federation (MPF), a union which represents Minneapolis police officers. The plaintiffs argued that, because Kroll had already lost a motion to dismiss in the Armstrong case, the court in the now-consolidated action should deny the April 11 motion to dismiss on grounds of issue preclusion. In an order filed July 1, 2022, the court found that issue preclusion applied. Thus, the dismissal in Armstrong was binding in Samaha, and the court accordingly denied the defendant’s motion to dismiss. 2022 WL 2392528.

The plaintiffs amended their complaint on June 14, 2022, to reflect the consolidation and incorporate allegations from Armstrong. Among other charges, the amended complaint described the actions of certain Minnesota State Police and named Major Joseph Dwyer as a defendant. The amended complaint likewise described certain actions taken by the MPF and named MPF President Robert Kroll as a defendant. On August 3, 2022, Dwyer moved to dismiss for lack of jurisdiction. Litigation in this case is ongoing as of October 2022, with trial currently scheduled for January 17, 2023.
