This is a case about Pennsylvania state troopers allegedly discriminating against people based on their perceived race, color, ethnicity, or national origin in stopping and detaining them for the purpose of investigating their immigration status. On April 8, 2019, three individuals initially filed this lawsuit in the U.S. District Court for the Middle District of Pennsylvania–there were ten total plaintiffs by the time the case settled. 

The plaintiffs sued Pennsylvania and individual state troopers under 42 U.S.C.  § 1983, alleging violations of the the Fourth and Fourteenth Amendments, and Title VI of the Civil Rights Act of 1964. Represented by the ACLU of Pennsylvania, and private counsel, the plaintiffs sought compensatory damages, punitive damages, and attorneys’ fees and costs. The case was assigned to Judge Yvette Kane. 

On April 18, 2022, the case was dismissed after the parties reported that they had reached a settlement. The settlement included $865,000 for individual payments to plaintiffs as well as attorneys’ fees. In addition, the state agreed to change its policies, forbidding officers from stopping drivers based on suspected immigration status and clarifying that an immigration detainer is not, on its own, a sufficient basis for detention or arrest. The settlement also required the state police department to keep records of all traffic stops, arrests, and detentions of foreign nationals.
