On May 19, 2017 the Lieutenant Governor of Utah issued an Order setting forth a special election to be held November 7, 2017 for a recent vacancy of the Third Congressional District of Utah. The terms of the special election process (including registration deadlines) made it impossible for the United Utah Party (an unincorporated political association of Utah citizens) to register a candidate.  

On June 21, 2017, the United Utah Party filed an action under 42 U.S.C. § 1983 seeking declaratory and injunctive relief prohibiting the Lieutenant Governor from failing to include the nominee of the United Utah Party on the ballot in the special election. Plaintiff argued that the special election violated rights guaranteed by the First and Fourteenth Amendments to the United States Constitution, as enforced by 42 U.S.C. § 1983.

On August 2, 2017, the District Court issued a Decision granting Plaintiff’s motion for preliminary injunction. The Court noted the Constitution guarantees the freedom to associate in political parties for the advancement of beliefs and ideas, and that the State’s interests do not require or justify effectively barring the United Utah Party (and its proposed candidate) from participating in the special election as a new political party. Accordingly, the Court ordered the Lieutenant Governor to include the United Utah Party candidate on the ballot for the special election.

On November 2, 2017, the Court ordered a permanent injunction enjoining the defendants from failing to include the United Utah Party's nominee. It also awarded the plaintiffs $115,000 for attorneys' fees and costs.
