On November 28, 2018, fourteen public school students filed this putative class action lawsuit against the State of Rhode Island and its state officials in the U.S. District Court for the District of Rhode Island.  Represented by Michael Rebel, the executive director of the Center for Educational Equity at Teachers College, Columbia University, as well as the the Rhode Island Center for Justice and a private law firm, the students alleged that the State had deprived them of their rights under the U.S. Constitution by failing to provide an adequate civics and social studies education that prepared them to be capable citizens.  Specifically, the students claimed that the constitution enshrines a right to an adequate education, which they argued the State had violated given the lack of any requirements for students to complete or be tested on a civics course throughout their education, a deficient state curriculum and a lack of opportunities for extracurricular experiences in the area.  They sued under 42 U.S.C. 1983 and claimed violations of the Equal Protection, Privileges and Immunities and Due Process Clauses of the Fourteenth Amendment, as well as the Sixth and Seventh Amendments, the related Jury Selection and Service Act (28 U.S.C. 1861) and the Republican Guarantee Clause of Article Four of the U.S. Constitution.  The students sought a declaratory judgment that all students in the U.S. have a constitutional right to a meaningful opportunity to obtain an education that sufficiently equips them to be capable voters and jurors and to exercise their constitutional rights and function as civic participants in a democratic society.  They also requested an injunction requiring the State to adopt laws, regulations, policies and practices to ensure the provision of those educational opportunities, in addition to attorneys' fees.  The case was assigned to Chief Judge William E. Smith and Magistrate Judge Patricia A. Sullivan.  

The State moved to dismiss the case on March 20, 2019, arguing that the Constitution does not guarantee a fundamental right to receive an adequate education in civics or social studies and that Plaintiffs lacked standing, failed to join indispensable parties and had failed to state a plausible cause of action.  Despite commending the plaintiffs for bringing their "ambitious" lawsuit, which "highlight[ed] a deep flaw in our national education priorities and policies,", Chief Judge Smith granted the motion on October 13, 2020 because the Supreme Court has not recognized a fundamental constitutional right to education and the plaintiffs had failed to adequately allege both arbitrary or irrational state official actions requiring rational basis review and a suspect class to trigger heightened scrutiny for their equal protection class claim.   494 F. Supp. 3d 170, 197 (D.R.I. 2020).  

Shortly thereafter, the students appealed to the U.S. Court of Appeals for the First Circuit.  The panel affirmed the decision of the District Court on January 11, 2022, finding that an adequate civics education in public schools was not a fundamental constitutional right and that the State's approach to civics education satisfied rational basis review for the equal protection and due process claims.  The Court also determined that the alleged lack of an adequate civics education neither violated the constitutional guarantee for every state to have a republican government nor the Constitution's privileges and immunities clause, but nevertheless lauded the students for having "called attention to critical issues of declining civic engagement and inadequate preparation for participation in civic life at a time when many are concerned about the future of American democracy."  23 F.4th 37, 48 (1st Cir. 2022)

In June 2022, plaintiffs agreed not to seek Supreme Court review.  Following the lawsuit, however, the State did announce that it would establish a Rhode Island Civic Readiness Task Force to consider specific measures to improve the quality of civics education in Rhode Island. In addition, the Rhode Island Commissioner of Education agreed to create rewards for students who excel in civics.  In September 2021, the state announced a new civics requirement for public high school students. The case is now closed.
