This is a case about COVID-19 policies for schools in Cobb County, Georgia. On October 1, 2021, four students, whose disabilities made them particularly vulnerable to COVID-19 and put them at an increased risk for severe symptoms or death from an infection, filed this lawsuit in the District Court for the Northern District of Georgia. The plaintiffs sued the Cobb County School District, members of the Cobb County School Board and the Board’s superintendent under Title 2 of the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act. Represented by the Southern Poverty Law Center, ACLU, and other private counsel, the students sought an injunction, a declaration of their rights under relevant law and damages. They claimed that ending COVID-19 safety measures for the 2021-22 school year subjected them to a higher risk of infection. As a result, the defendants had discriminated against them by unlawfully denying students with disabilities and medical conditions access to a safe learning environment. The case was assigned to Judge Timothy C. Batten.

The court ordered expedited briefing and held a hearing on October 15, 2021. Following the hearing, the court found that the students failed to establish that they had a substantial likelihood of winning the case at trial. The court concluded that plaintiffs failed to show that they were subjected to disparate treatment, because they were not treated differently from other students. The COVID policies applied to all students, and all students were free to choose virtual classes, making the policy facially neutral. The court also concluded that the defendants had not failed to accommodate the students. Though the policies in place were not the preferred policies of the plaintiff, the court found that the existing accommodations were adequate to provide plaintiffs with meaningful access to education. The injunction, and other relief, was denied.

Plaintiffs filed an interlocutory appeal with the U.S. Court of Appeals for the Eleventh Circuit on November 10, 2021, and a motion to stay proceedings in the district court pending the Court of Appeals decision on November 30, 2021. The district court granted the stay on December 2, 2021.  

On December 16, 2022, the Eleventh Circuit reversed and remanded the district court's denial. In an opinion written by Circuit Judge Charles R. Wilson, the circuit court held that plaintiffs' claim remained a live controversy that survived mootness and that the district court erred in its review of plaintiffs' discrimination claims. The circuit court found that the district court had abused its discretion by redefining the scope of accommodations sought by plaintiffs (which were merely compliance with CDC Covid-19 regulations) and failing to consider plaintiffs' unjustified isolation theory, which the U.S. Supreme Court held was a form of discrimination against disabled people in Olmstead. The circuit court remanded the case for analysis as to the benefits that would be provided to plaintiffs by in-person schooling.
