This case is about jail conditions in the Allegheny County Jail (ACJ), particularly access to mental health care for incarcerated people with psychiatric disabilities. On September 15, 2020, five individuals then incarcerated at ACJ, represented by the Abolitionist Law Center, the Pennsylvania Institutional Law Project, and a private firm, brought this putative class-action lawsuit in the U.S. District Court for the Western District of Pennsylvania on behalf of themselves and other persons with psychiatric disabilities housed in the jail.

Bringing suit against Allegheny County and administrators of ACJ, the plaintiffs alleged that conditions and practices at ACJ violated the Fourteenth Amendment; the Americans with Disabilities Act (ADA), 42 U.S.C. § 12132; and the Rehabilitation Act, 29 U.S.C. § 794. The case was assigned to Magistrate Judge Lisa Pupo Lenihan on September 23, 2020.

The plaintiffs specifically alleged that the defendants discriminated against persons with disabilities by failing to reasonably accommodate their psychiatric disabilities in violation of the ADA and the Rehabilitation Act. The plaintiffs asserted that ACJ was insufficiently staffed, did not provide adequate training to staff on interacting with individuals with psychiatric disabilities, lacked any reliable system for diagnosing or screening for mental health conditions, used excessive force against individuals with psychiatric abilities, placed persons who requested psychiatric treatment in solitary confinement, and otherwise denied them benefits and services at the jail by reason of their psychiatric disabilities. 

Under the Fourteenth Amendment, the plaintiffs alleged that ACJ:

  • failed to provide adequate healthcare;
  • placed incarcerated individuals with psychiatric disabilities in solitary confinement excessively and without adequate due process;
  • used excessive force against individuals with psychiatric disabilities, including placing them in restraints for up to eight hours at a time without bathroom breaks; and
  • failed to adequately train jail staff on how to manage and interact with incarcerated people with psychiatric disabilities.

Citing a number of class members attempting suicide, including nine suicide completions, as a result of the trauma of the jail treatment conditions, the plaintiffs sought declaratory relief and an injunction prohibiting the defendants from engaging in the alleged unlawful practices and ordering the defendants to provide adequate mental health care, as well as attorneys' fees.

On December 7, 2020, the parties agreed to engage in alternative dispute resolution, with mediation set for March 12, 2021. Throughout the remainder of 2020 and the beginning of 2021, the parties engaged in pre-mediation discovery. Mediation took place as scheduled on March 12, 2021, but the parties were unable to resolve the case. Ten days later, the parties informed the court they were unlikely to reach a global settlement, but were optimistic that some issues could be resolved out-of-court. Subsequently, discovery began in earnest.

The court held proceedings to resolve a number of discovery disputes on June 29, 2021. After the hearing, Judge Lenihan indicated that the court would certify a class of persons with serious mental health conditions, though the scope of the class was still subject to debate. Judge Lenihan also ruled that the plaintiffs were entitled to retrospective discovery, including information on incarcerated persons beginning one year prior to the filing of the complaint and information as to staffing and other discovery covering at least the same period and perhaps longer, to be determined by the parties if possible. Following a November 29, 2021 hearing on new and continuing discovery issues, the court ordered ACJ to produce medical and housing records, training materials, staff identities, and use of force logs.

On February 15, 2022, the plaintiffs moved to withdraw one of the class representatives and substitute a new class representative in their place. Judge Lenihan granted the motion the following day.

On June 9, 2022, the plaintiffs moved to certify the class of "all individuals currently or in the future incarcerated in Allegheny County and who have, or in the future will have, a serious mental health diagnosis, disorder or disability as recognized in the DSM-V." That motion was granted by Judge Lenihan on October 31, 2022. 2022 WL 16553239.

During the second half of 2022, the court ruled on several additional discovery disputes. In mid-July, Judge Lenihan set an outstanding discovery deadline of August 15, 2022 and clarified the bounds of an ACJ site visit by the plaintiffs' experts. The parties agreed that the plaintiffs' experts would be permitted to conduct brief examinations of any class representatives. The court ruled over the defendant's objection that the experts would also be permitted to conduct brief examinations of certain putative class members then housed at ACJ who would be identified by plaintiffs' counsel. The court declined to permit the experts to examine any additional inmates they might identify as potential putative class members during the site visit, instead ruling that those examinations could only take place at a later date. In late-September, Judge Lenihan ordered the defendants to produce information on all deaths involving persons with mental illness at ACJ in the prior two years. The parties continued to litigate discovery disputes. 

After a June 28, 2023 status conference, the court noted that expert discovery was complete, but settlement discussions were ongoing. The parties once again entered mediation in July and August 2023. The parties also attended various settlement conferences in August, September, and October 2023. The case was administratively closed on September 29, 2023.

On November 13, 2023, Magistrate Judge Lenihan retired, and the case was assigned to Judge David S. Cercone. In November 2023, after mediation was unsuccessful, the court reopened the case. The case was reassigned from Judge David S. Cercone to Magistrate Judge Kezia O. L. Taylor on January 3, 2024. However, the defendants filed a motion for recusal on January 29, 2024. The court granted the motion out of “an abundance of caution” for having conceivable personal knowledge of disputed evidentiary facts. Subsequently, Magistrate Judge Cynthia Reed Eddy was assigned to the case in February 2024.

On March 19, 2024, the parties reached a settlement and filed a joint motion for approval. The settlement required the defendants to make significant changes to improve the jail’s treatment of people with psychiatric disabilities, including training mental health staff and correctional officers, reining in the use of force through de-escalation techniques, meeting required staffing levels, preventing people with mental health conditions from staying too long in segregation, and providing individual mental health counseling. The agreement also required a monitor to be appointed who would ensure the defendants followed the terms of the agreement. The court granted preliminary approval on March 21, 2024.

The final approval hearing is set for June 10, 2024. As of March 2024, the case is ongoing.

As to staffing and other discovery it may not be unduly burdensome to go back further than that and the parties should discuss this. The Court suggested an informal meeting with counsel and a representative from the mental health unit of the ACJ to help with further defining issues. IT IS HEREBY ORDERED that, no later than December 20, 2021, the following will be produced: (1) Medical records of all 100 representative sample. (2) Housing records for the representative sample. (3) Training materials that pertain to corrections staff interacting with inmates with serious mental health issues. Defendants state that there is no specific focused training for the interaction with inmates with serious mental health issues; however, it is included in other training. Following receipt of same, Sergeant Justice, head of training for ACJ, will be made available for deposition. (If additional relevant information is revealed during Justices deposition that was not provided, Plaintiffs reserve the right to conduct a follow up deposition.) Defendant will also provide names of other persons involved in training. (4) Materials and information for training mental health staff who work at ACJ as well as the identities of individuals involved in said training. (Defendants advise that they do not train on mental health procedures but do train on general processes and procedures for persons who work at ACJ.)
