Section 5 of the National Voter Registration Act (NVRA) provides that when a registered voter changes their address with a state motor vehicle agency, the corresponding voter registration address must be automatically updated. This led three civic organizations to sue the Arizona Secretary of State (SOS) on August 18, 2018, for allegedly violating the NVRA. The suit was brought to the U.S. District Court for the District of Arizona. The plaintiffs alleged that the SOS did not update voter registration addresses of individuals who changed their address with the Arizona Department of Transportation (ADOT) and its Motor Vehicle Division (MVD). According to the plaintiffs, this issue created a discrepancy that disenfranchised voters. That is, when an individual submitted a ballot at a precinct other that listed on the old voter registration, votes were rejected. The plaintiffs requested injunctive relief and asked that the court enjoin the SOS from violating the NVRA, implement a plan to ensure SOS compliance with the NVRA, and direct the SOS take steps to ensure all registered voter ballots are counted.

Judge James A. Teilborg was assigned to the case after Judges Deborah M. Fine and John J. Tucci recused themselves. On August 18, 2018, the plaintiffs filed a motion for preliminary injunction. One month later, on September 18, 2018, Judge James A. Teilborg denied the motion. In his opinion, Judge Teilborg noted multiple issues with the plaintiffs' argument. He explained that, among other issues, there was no deprivation of a constitutional right and the plaintiffs did not show evidence of voter disenfranchisement. 

On January 6, 2020, the parties filed a joint motion and stipulation for dismissal because they had entered into a settlement agreement on January 2. The parties agreed that the defendants would treat address changes, both in-person at MVD offices and online on ADOT's website, as address changes for voter registration purposes. To accompany these changes, ADOT agreed to implement training on these new policies. The SOS also agreed to forward address updates from ADOT to the appropriate county recorders to ensure changes to voter registrations. In addition, the SOS agreed to designate staff positions whose responsibilities would ensure that the SOS and ADOT comply with the NVRA. The settlement agreement also laid out provisions regarding data collection and reporting related to the policy changes. It was set to expire on December 31, 2023.

The motion for dismissal was granted on January 8, 2020. The case is now closed.
