Represented by private counsel and attorneys from Justice Catalyst Law, the plaintiff sought class certification, compensatory damages, punitive damages, and attorneys' fees. The plaintiff alleged that the County had a policy of continuing to incarcerate people after the District Attorney’s Office (DA) declined to prosecute them—thereby ending the legal basis for incarceration. The plaintiff alleged that the County continued to detain individuals until the night of their prescheduled first appearance date despite having immediate access to the DA’s decision not to prosecute. This detention allegedly lasted two days in the plaintiff’s case and as many as six days in other cases. The case was assigned to District Judge Edward J. Davila on May 24, 2021. 

The parties reached a preliminary settlement agreement at a settlement conference on January 25, 2022 before Magistrate Judge Laurel Beeler. After the conference, however, the parties disagreed over language in the Motion for Preliminary Approval and required an additional settlement conference on July 27, 2022 to discuss the language holding up the agreement. On August 4, 2022, the parties notified the court that the drafting issue had been resolved. Plaintiff filed the First Motion for Preliminary Approval of Class Action Settlement on August 12, 2022 and then filed an amended motion on August 30 after a hearing the previous day. 

The terms of the settlement required the County to pay $2.375 million into a settlement fund. Class members who were incarcerated for more than 12 hours after the DA declined to prosecute were awarded damages based on the length of their wrongful incarceration: $250 per hour for each hour of compensable detention from 12 to up to 24 hours and $295.00 per hour for each hour over 24 hours. Out of the total settlement fund, $395,000 was set aside for settlement administration costs—$50,000 to the Settlement Administrator, $20,000 to the named plaintiff as an incentive award, and the remainder to attorney’s costs and expenses.

Judge Davila granted preliminary approval of the settlement on September 6, 2022, and the final approval hearing was set for December 8, 2022. Class members were given until October 28, 2022 to object to the terms of the settlement or opt out. The case is ongoing.
