Case Summary

This is a case about a large-scale immigration and law enforcement raid on a predominantly Latino apartment complex in Nashville, Tennessee, that occurred on October 20, 2010. The plaintiffs were 15 individuals who were victims of the raid and residents of the apartment complex, the Clairmont. The plaintiffs brought this action nearly one year later on October 19, 2011, in the U.S. District Court for the Middle District of Tennessee to remedy violations of their Fourth, Fifth, and Fourteenth Amendment rights. Specifically, the plaintiffs alleged, among other things, that the defendants’ actions during the raid amounted to unreasonable search and seizure; discrimination on the basis of race, ethnicity, and national origin; and excessive use of force. The plaintiffs further made allegations that the defendants conspired to deprive the plaintiffs of their constitutional rights. The plaintiffs brought these claims under 42 U.S.C. §§ 1983 and 1985 as well as Bivens. The plaintiffs requested declaratory, punitive, and compensatory relief in addition to attorneys’ fees. The case was assigned to Judge Todd J. Campbell.

On June 12, 2012, the plaintiffs amended their complaint to include alleged violations of the Fair Housing Act.

On April 1, 2013, Judge Campbell granted the federal defendants' motion to dismiss the plaintiffs’ claims arising under §1983. Judge Campbell found that the federal defendants were not acting under the color of state law and thus that §1983 did not apply to them. Judge Campbell did, however, find that the plaintiffs’ claims of Fourth and Fifth amendment violations under Bivens were sufficient. Contentious discovery continued, with the court issuing sanctions in the form of attorneys’ fees totaling $75,000 against Immigration and Customs Enforcement (ICE) on September 4, 2013.

The parties filed cross motions for summary judgment, which Judge Campbell resolved in four separate orders all issued on September 4, 2014. In all, the plaintiffs’ claims were largely left for jury trial, as the court did not grant summary judgment as to many claims for any party. The court did, however, grant summary judgment as to some of the real estate management companies on a few of the plaintiffs’ claims against those defendants.

While the case was set for trial, the parties instead settled. First, the plaintiffs and defendant real estate management companies stipulated to a voluntary dismissal of all claims on April 28, 2015. On July 27, 2015, the remaining parties reached a settlement agreement. The remaining defendants agreed to pay the plaintiffs $310,000 to settle all claims. The plaintiffs who were noncitizens were also granted deferred action status for 7 years by ICE.
