Two female student-athletes attending James Campbell High School filed a class action suit on December 6, 2018, against the school, the Hawai'i State Department of Education ("DOE"), and the Oahu Interscholastic Association ("OIA") in the U.S. District for the District of Hawai'i. Two more female student-athletes joined as named plaintiffs through an amended complaint filed on September 26, 2019. Plaintiffs were represented by the ACLU of Hawaii and Legal Aid at Work. The lawsuit was brought under Title IX, a federal law requiring gender equity in education, including athletics. District Judge Leslie E. Kobayashi presided over the case.

Plaintiffs alleged that despite being on notice of disparities between that athletic facilities for female and male student-athletes for decades, the DOE continued to prioritize upgrading facilities for male athletes over providing any facilities at all for female athletes. The OIA, administered policies and regulations for interscholastic athletics in Oahu-based DOE schools, allegedly also discriminated against female athletes by prioritizing male athletes in scheduling games, seasons, and tournaments as well as publicizing and promoting male athletic competitions. 

On January 18, 2019, the OIA filed a motion to dismiss that District Judge Kobayashi denied on May 24, 2019. The OIA argued that the plaintiff's Title IX claim was not valid as the OIA did not receive federal funds, one of the components of a Title IX claim. Judge Kobayashi disagreed and found that plaintiffs had asserted enough facts to plausibly show that the OIA was an indirect recipient of federal funds through the DOE and therefore was subject to Title IX. 386 F. Supp. 3d 1352 (D. Haw. 2019).

Plaintiffs sought declaratory and injunctive relief against defendants for three violations of Title IX: unequal treatment and benefits in athletic programs, unequal participation opportunities in athletic programs, and retaliation by the DOE for complaints of discrimination. Plaintiffs also sought a class certification to include all current and future female student-athletes at Campbell High School. On December 31, 2019, District Judge Leslie E. Kobayashi denied the Plaintiff's motion for class certification due to failure to satisfy the numerosity requirement and the commonality and typicality requirements for the retaliation allegation. Judge Kobayashi found that because all the members of the proposed class were students at a singular high school it would be possible to add them via joinder and that the retaliation claim was specific to one team's interactions with the school administrators at the time. 334 F.R.D. 600 (D. Haw. 2019).

Plaintiffs appealed the denial on January 14, 2020 and on April 4, 2022 the Court of Appeals for the Ninth Circuit reversed the denial and remanded the case to District Court. The three-judge panel consisted of Circuit Judges Richard R. Clifton, Ryan D. Nelson, and Daniel P. Collins. The Ninth Circuit’s opinion, written by Judge Collins, held that plaintiffs had satisfied the numerosity requirement due to their proposed class exceeding 300 people and that plaintiffs satisfied the commonality and typicality requirements for the retaliation charge due to the class-wide effect of the retaliation. 30 F.4th 828 (D. Haw. 2019).
