This was a case about access to ballot drop boxes in Texas during the COVID-19 pandemic. On October 1, 2020, after voting had begun in the state, Governor Abbott issued a proclamation prohibiting Texas counties from providing absentee voters with more than one location to return absentee ballots. On October 2, 2020, a 65-year old Texas citizen and voter, the Texas Alliance for Retired Americans and Bigtent Creative filed a complaint for declaratory and injunctive relief in the U.S. District Court for the Western District of Texas, suing Governor Abbott and Secretary of State Hughs. The Texas Alliance for Retired Americans represents retired Americans who reside in Texas.  Bigtent Creative is a non-partisan get-out-the-vote non-profit that had expended funds to inform Texas voters of COVID-related voting measures.

The plaintiffs alleged violations of The Enforcement Act of 1871 (also known as the Ku Klux Klan Act), and the First and Fourteenth Amendments. They argued this change impermissibly restricted the ability to vote in violation of the First Amendment. They also claimed that the change violated the Ku Klux Klan Act by directly or indirectly depriving a class of persons equal protection of the laws, and that the change represented a conspiracy to prevent voters from supporting a candidate for presidential or congressional office. Plaintiffs further claimed that changing voting requirements after voting began was arbitrary and capricious, and a violation of the Fourteenth Amendment, because it would cause disparate burdens to the elderly, who had a greater need to avoid crowded voting locations because 70% of COVID deaths in Texas had occurred among those over the age of 65. Plaintiffs argued that given the size of Texas counties, people may have already requested absentee ballots that would no longer be able to submit them on time. In response, the defendants argued that because they had expanded voting timeframes to allow ballot drop off up to forty days in advance, instead of just election day, they had in fact expanded voting rights access. They also pointed to security concerns with multiple drop-off sites. The case was assigned to District Court Judge Robert Pitman.

On October 5, 2020, plaintiffs filed a motion for a temporary restraining order and a preliminary injunction to enjoin enforcement of the proclamation. That same day, plaintiffs filed a motion to consolidate the hearing of their motion with that in Texas LULAC v. Abbott, a case challenging the same ballot drop box restrictions.  On October 6, 2020, the court consolidated the case with LULAC for the limited purpose of resolving the pending motions for preliminary injunction.  (The court ruled that the plaintiffs' motion to consolidate was moot in light of its consolidation order.)

On October 6, 2020, Governor Abbott and Secretary of State Hughs filed a motion to dismiss the complaint. They argued that plaintiffs' constitutional claims were barred by sovereign immunity, and that the Ex Parte Young exception to immunity did not apply, because neither defendant was empowered to enforce the executive order. 

On October 9, 2020, Judge Pitman, ruling in the consolidated action, granted in part and denied in part the motion to dismiss.  The court dismissed the claims against Governor Abbott, finding that the Ex Parte Young exception to sovereign immunity did not apply to the Governor since he was not empowered to enforce the law.  The Court held that the action could proceed against Secretary of State Hughs, to whom the exception did not apply because Texas Election Code clearly tasked the Secretary with enforcing election laws in the state.  In the same ruling, the court issued a preliminary injunction, barring county clerks and other state actors from implementing or enforcing the October 1 Proclamation limiting ballot drop boxes. The same day, defendant Hughs appealed the preliminary injunction ruling to the U.S. Court of Appeals for the Fifth Circuit.

On October 12, 2020, less than a month before election day, the Fifth Circuit granted appellant Hughs a stay of the preliminary injunction, pending resolution of her appeal. The court did not provide any reasoning for this order. 978 F.3d 136. The stay, which remained in effect through the conclusion of the election, effectively left each county with a single ballot drop box available, per Governor Abbott's proclamation. 

On February 22, 2021, the Fifth Circuit vacated the District Court's preliminary injunction order and remanded the case with instructions to dismiss it as moot because the election had already taken place. 2021 WL 1446828. The District Court dismissed the action as moot on March 24, 2021.
