On November 15, 2021, the State of Texas and the Texas Health and Human Services Commission (collectively, “Texas”) filed this suit in the U.S. District Court for the Northern District of Texas to challenge an interim final rule published by the Centers for Medicare & Medicaid Services (“CMS Vaccine Mandate”). The CMS Vaccine Mandate required vaccination against COVID-19 for all “faculty staff” including employees, trainees, students, volunteers, and contractors “who provide any care, treatment, or other services” at healthcare facilities receiving Medicare or Medicaid funding. The CMS Vaccine Mandate allowed for exemptions pursuant to federal anti-discrimination and civil rights laws, including medical and religious exemptions. Texas alleged, inter alia, that CMS lacked statutory authority to adopt the CMS Vaccine Mandate, that CMS failed to follow the procedural rules necessary for adopting a rule pursuant to the Administrative Procedure Act (APA) and the Social Security Act (SSA), that CMS acted arbitrarily and capriciously in adopting the CMS Vaccine Mandate in violation of the APA, and that the Mandate was an unconstitutional invasion of the traditional provinces of states. Texas sought declaratory and injunctive relief as well as attorneys’ fees and costs. U.S. District Judge Matthew J. Kacsmaryk presided over this case.

The following day, Texas filed a motion for a temporary restraining order and preliminary injunction. On December 15, 2021, the district court issued an opinion and order granting Texas’s motion for a preliminary injunction. 575 F.Supp.3d 701. Pursuant to the order, the defendants were preliminarily enjoined from implementing and enforcing the CMS Vaccine Mandate against Medicare- and Medicaid-certified providers and suppliers in Texas. The District Court found that Congress did not grant the Department of Health and Human Services (HHS) Secretary the authority to regulate “health and safety” in a way that conditioned employment of healthcare workers, and Texas was thereby likely to succeed on the merits of its claim that CMS exceeded its statutory authority. With respect to rulemaking procedures, the district court found that the defendants lacked “good cause” to skip the notice-and-comment period because public comment would have been in the public’s interest, that CMS failed to consult with state agencies prior to implementing the CMS Vaccine Mandate, and that the HHS Secretary did not prepare a Regulatory Impact Analysis. Third, because the district court found that CMS could not justify such a broad application of the CMS Vaccine Mandate, the District Court found that Texas was likely to win on the merits of its claim that the Mandate was arbitrary and capricious. Because the court found that Texas would otherwise suffer irreparable injury, it granted a preliminary injunction.

On January 14, 2022, the defendants filed a notice of interlocutory appeal to the U.S. Court of Appeals for the Fifth Circuit. Four days later, Texas filed a motion to dismiss without prejudice in light of the U.S. Supreme Court’s ruling in Biden v. Missouri, 142 S.Ct. 647 (2022), in which the U.S. Supreme Court granted the government’s motion to stay injunctions issued by two other district courts concerning the Mandate. Accordingly, on January 19, 2022, the district court in this case granted the plaintiffs’ motion to dismiss without prejudice.

ORDER: Before the Court are Defendants' Motion to Stay Further Proceedings (ECF No. 56), Defendants' Motion for a Stay of the Injunction Pending Appeal (ECF No. 60), and Plaintiffs' Motion to Dismiss (ECF No. 63). Considering the U.S. Supreme Court's ruling in Biden v. Missouri, --- S.Ct. ---, Nos. 21A240 and 21A241, 2022 WL 120950 (U.S. Jan. 13, 2022), the Court finds that Plaintiffs' Motion to Dismiss should be and is hereby GRANTED. The Court dismisses the claims in this matter WITHOUT PREJUDICE pursuant to Federal Rule of Civil Procedure 41(a)(2). The parties shall bear their own fees and costs related to this litigation. Accordingly, Defendants' Motion to Stay Further Proceedings and Motion for a Stay of the Injunction Pending Appeal are DISMISSED as moot. (Ordered by Judge Matthew J.
