This is a case about voter dilution and preclearance of voting rights changes. 

On November 12, 2014, registered Hispanic voters of the City of Pasadena, Texas filed this lawsuit in the U.S. District Court for the Southern District of Texas. Plaintiffs sued the City of Pasadena, the Mayor, and members of the Pasadena City Council under 42 U.S.C. § 1983 and the Voting Rights Act of 1965, 52 U.S.C. § 10301 (formerly 42 U.SC. § 1973). Specifically, Plaintiffs claimed that the City altered its governmental electoral structure to diminish the voting power of the growing Hispanic community by changing its districting plan from eight single-member districts to a hybrid map with six single-member districts and two at-large districts. This change effectively eliminated a Hispanic district. Represented by the Mexican American Legal Defense and Educational Fund, Plaintiffs sought declaratory judgment that the hybrid election system for Pasadena City Council violated their civil rights under the Fourteenth and Fifteenth Amendment and the Voting Rights Act by unlawfully diluting the voting strength of Hispanics and intentionally discriminating against them on the basis of race and national origin. Plaintiffs further sought a permanent injunction prohibiting the calling, holding, supervising, or certifying of any future Pasadena City Council elections under the hybrid election system and the creation of an election system that would not dilute the voting strength of Hispanic voters. Finally, Plaintiffs sought an order subjecting the City of Pasadena to the preclearance requirement of section 5 of the Voting Rights Act under 42 U.S.C. § 1973a(c), and attorney’s fees and costs. 

On January 9, 2015, the City field a motion to dismiss the official-capacity named defendants (i.e., the Mayor and City Council members). The City argued that because the governmental entity was named and subject to being sued directly, Plaintiffs needlessly named the government officers. Simultaneously, on January 9, 2015, the City filed its initial answer to the complaint.  

On January 22, 2015, three Council members filed their own answer to the initial complaint, having sought to appear in the litigation in a capacity that was independent of the other named defendants and to be represented by legal counsel separate from the City due to a legal conflict. Further, on January 22, 2015, those same three Council members filed a motion to strike unauthorized pleadings (specifically, the motion to dismiss and answer previously filed by the City) and a motion to show authority as to how the parties could be represented by counsel against their wishes and in the face of a possible legal conflict. 

On March 27, 2015, the court granted the City’s motion to dismiss the official-capacity defendants and denied as moot the three defendants’ motion to strike unauthorized pleadings. 

On July 6, 2015, Plaintiffs filed an amended complaint, which added and removed certain Plaintiffs from the initial complaint.

For the next year, the parties engaged in discovery and alternate dispute resolution. On July 1, 2016, the City filed a motion for summary judgment, arguing that the challenged hybrid election system satisfied the requirements of the Voting Rights Act because it afforded the Hispanic voting population the opportunity to elect in a number of districts that were proportionate to the group’s share of the relevant population. On July 30, 2016, Plaintiffs filed their response in opposition to the City’s motion for summary judgment, arguing that the City’s theory of proportionality did not, as a matter of law, entitle it to summary judgment. Finally, Plaintiffs argued that the City was incorrect that proportionality foreclosed Plaintiffs’ claims of intentional discrimination under the Fourteenth and Fifteenth Amendments. 

On August 11, 2016, Plaintiffs filed a motion to strike the City’s summary judgment evidence. Specifically, Plaintiffs argued that the City’s evidence in support of its summary judgment motion that included certain expert and/or lay witness testimony was inadmissible due to the City’s failure to properly disclose the witness in discovery. On August 24, 2015, the court granted Plaintiffs’ motion to strike and denied the City’s motion for summary judgment, finding that the City’s application of the proportionality analysis was at odds with the application of prior holdings by the United States Supreme Court. 

The court held a seven-day bench trial from November 17, 2016 to December 2, 2016. 

On January 6, 2017, the court entered an opinion and final judgment in favor of Plaintiffs. Specifically, the court found an intent to disproportionately and discriminatorily dilute Hispanic minority voting strength through the City’s amended hybrid election system in violation of the Fourteenth Amendment and the Voting Rights Act. 230 F.Supp.3d 667.

On January 16, 2017, the court entered final judgment in favor of Plaintiffs and ordered a permanent injunction against the City permanently enjoining it from conducting the May 2017 City Council election or any subsequent City Council elections under the six single-member district and two at-large position redistricting map and plan adopted in 2014. The court also ordered the City to conduct the May 2017 City Council elections using the previous eight single-member district map and plan that was in effect on December 1, 2013 and that the City had used in its May 2013 elections. Further, the court entered an order under section 3(c) of the Voting Rights Act to retain jurisdiction for a period of six years (to end on June 30, 2023) to review before enforcement any change to the election map or plan that was in effect in Pasadena on December 1, 2013. The court ordered that any change to the City’s map or plan could be enforced without court review only if it had been submitted to the United States Attorney General and the Attorney General had not interposed an objection within sixty days (“preclearance”). 2017 WL 10242075.

On January 17, 2017, the City appealed to the United States Court of Appeals for the Fifth Circuit from the final judgment and order of injunction entered by the court. The City also moved the district court for a stay of the judgment and order of injunction pending the outcome of the appeal. On January 18, 2017, the court denied the City’s motion to stay. 229 F.Supp.3d 582.

On February 3, 2017, the United States Court of Appeals for the Fifth Circuit denied the City’s motion for a stay of the district court’s judgment and injunction pending the appeal, finding that the City had failed to meet its heavy burden to justify a stay pending appeal with respect to the district court’s holding on the discriminatory effect of the hybrid election structure. Specifically, the Fifth Circuit found that the likelihood of the City’s success on the merits was not strong enough to tip the balance in favor of staying the injunction. 677 Fed. Appx. 950.

On September 27, 2017, the City settled the lawsuit, agreeing to pay the total amount of $1,097,341.00 for Plaintiffs’ attorneys’ fees and costs incurred in the litigation, and on October 18, 2017, the City’s appeal to the United States Court of Appeals for the Fifth Circuit was dismissed.

In 2022 and 2023, the City filed unopposed motions for the court to preclear or to determine that preclearance was not required as to a a variety of election changes. The court approved each motion or determined that preclearance was not necessary. Because the six-year enforcement period ended on June 30, 2023, this case is now closed.
