Case Summary

This is a case about racial discrimination and race-based threats on the University of Iowa football team. On November 12, 2020, a group of thirteen Black former and current Iowa football players filed this lawsuit in the Iowa District Court for the State of Iowa, Polk County (a state trial court). This is a case about racial discrimination and race-based threats on the University of Iowa football team. On November 12, 2020, a group of thirteen Black former and current Iowa football players filed this lawsuit in the Iowa District Court for the State of Iowa, Polk County (a state trial court). However, shortly after, on December 1, 2020, the defendants successfully removed the case to a federal court, the United States District Court for the Southern District of Iowa, Central Division. The case was assigned to Judge Stephanie M. Rose.

The football players alleged that Head Coach Kirk Ferentz and Head Strength and Conditioning Coach Christopher Doyle enabled bullying, disparate treatment, discrimination, and threats. A 2019 internal diversity task force and a 2020 law firm report both confirmed the discrimination, but Ferentz and other team leadership did not make changes. The players' Complaint levied eight claims against the University of Iowa, the State of Iowa, and associated actors, such as the Board of Regents and various coaches and athletic staff. Plaintiffs alleged deprivations of constitutional rights as well as violations of Title VI. Represented by private law firms, the football players sought actual, compensatory, and punitive damages, plus attorney's fees and costs; declaratory judgment; injunctive relief requiring the University to implement policies and procedures to halt and prevent discrimination, and equitable remedies including mandatory anti-racist training, a board of African-American advisors to monitor the program, tuition waivers for any non-graduating African-American athletes who attended Iowa during Ferentz's tenure, and any other necessary steps to cease discrimination.

On December 14, 2020, the defendants filed a motion to dismiss for failure to state a claim. The motion to dismiss also alleged that the statute of limitations had expired. The players filed a First Amended Complaint on January 13, 2021. In response, the defendants filed a new motion to dismiss on January 25, 2021.

On May 6, 2021, Judge Rose analyzed various statutes of limitations and the sufficiency of the facts, ultimately dismissing many but not all claims on one of these two grounds. She dismissed five plaintiffs who had graduated more than four years ago and dismissed most of the athletic staff defendants, including Head Coach Ferentz, but not Head of Strength and Conditioning Coach Doyle. Of the original eight claims, she retained two: the racially hostile educational environment claim and the deprivation of the right to make and enforce contracts per 42 USC § 1981. The first claim could only be brought by players who had graduated within two years. The second claim could only be brought by players who had graduated within four years, and could not be brought against the University's Athletics Director. 2021 WL 10257221.

For the next year or so, the parties engaged in discovery. On August 19, 2022, the players filed a Second Amended Complaint to remove the previously dismissed claims and to add two new claims. The first new claim was that three athletic staff members violated the Fourteenth Amendment's Equal Protection Clause by depriving the players equal educational opportunities. The second new claim reinstated Head Coach Ferentz as a defendant and alleged that he failed to train and supervise staff and employees.

Soon after, on September 2, 2022, various defendants filed separate motions to dismiss the amended complaint. Further, on September 12, 2022, Head Strength and Conditioning Coach Doyle filed a motion for summary judgment, arguing that the claims did not have merit and that in any case, he was entitled to qualified immunity. The next day, numerous defendants filed motions to stay discovery pending the qualified immunity issue. In response, the players argued on September 27 that the stay request was discovery obstruction. The players responded to the motion for summary judgment on October 4, 2022. After additional briefing by the defendants, the Court held hearings and oral arguments on December 28, 2022 and January 11, 2023.

In late February of 2023, the plaintiffs voluntarily dismissed the athletic staff members as defendants. The parties signed a settlement agreement on February 23, 2023 and notified the Court of this on March 6, 2023. The settlement called for a $4.2 million payment to plaintiffs, with the state of Iowa paying $2 million and the Iowa athletics department paying the balance. Additionally, the University agreed to commit $90,000 to support graduate or professional school tuition expenses and fees for the players who sued — including books but excluding housing and meals. The University also agreed to provide the players in the lawsuit with a year of mental health counseling and to support registration and travel fees for up to 10 student-athletes interested in participating in the annual Black Student Athlete Summit annually through 2026. Lastly, the University hired a DEI expert to help the athletics department with operationalizing its current five-year diversity, equity and inclusion strategic plan.

As a result of the settlement agreement, the Court dismissed all the claims with prejudice, with all parties to pay their own costs and fees, on March 30, 2023.
