On July 8, 2020, the plaintiff, a pretrial detainee at the Cumberland County Department of Corrections (CCDOC) in the state of New Jersey filed this lawsuit in the District of New Jersey individually, and in another similar lawsuit on June 26, 2020, Brown v. On July 8, 2020, the plaintiff, a pretrial detainee at the Cumberland County Department of Corrections (CCDOC) in the state of New Jersey filed this lawsuit in the District of New Jersey individually, and in another similar lawsuit on June 26, 2020, Brown v. Warren, on behalf of a class. The plaintiff filed pro se, and was repeatedly denied his request for an attorney until a New Jersey firm took on his case pro bono. The plaintiff filed suit against the CCDOC, Cumberland County New Jersey, CFG Health Systems, and many employees individually and in an official capacity under 42 U.S.C. §§1983 and 1988 for violating his constitutional rights. The plaintiff sought damages, declaratory and injunctive relief, attorney fees and costs, and any other relief the Court deemed just and proper. 

The plaintiff filed a separate class action suit against the CCDOC for the treatment he received during the initial height of the COVID-19 pandemic while he was held in the CCDOC awaiting trial. The plaintiff testified on April 21, 2021 regarding the CCDOC’s poor, unhygienic, and unsafe conditions in the Cumberland County Jail brought on by the pandemic.  On April 29, 2022, the plaintiff filed an amended complaint. In the amended complaint, the plaintiff alleged that he was retaliated against for filing his initial suit, and for testifying regarding the violations of his constitutional rights in ways including but not limited to, lack of adequate medical care, being separated from his co-plaintiffs, and receiving excessive punishment for minor infractions.  

The plaintiff filed seven counts: 

  1. Unlawful retaliation in violation of the plaintiff’s first amendment rights
  2. Deliberate indifference to the plaintiff’s serious medical needs in violation of the plaintiff’s eighth and fourteenth amendment rights.  
  3. Infringement upon the plaintiff’s right to free speech under Article I ¶ 6 of the New Jersey Constitution.
  4. Cruel and unusual punishment under Article I ¶ 12 of the New Jersey Constitution.  
  5. Intentional Infliction of Emotional Distress
  6. Negligent Infliction of Emotional Distress
  7. Monell Liability for the actions of those employed by the County. 

 The defendants moved to dismiss the amended complaint for failure to state a claim, and both parties jointly moved to seal their briefs and certain exhibits.  On January 5, 2023, the court granted both of these motions in part, but largely denied them.  The court allowed for some sensitive pieces of material to be redacted, and for one of the plaintiff’s exhibits to be sealed, but given the nature of the claims the intimate details of the plaintiff’s health and the defendants actions were deemed too integral to the case to be sealed. The court determined that redacting the documents would suffice to protect the privacy of the plaintiff and others named in the documents, including other inmates. Regarding the motion to dismiss, the court refused to dismiss all claims except for the plaintiff’s claim of IIED against Cumberland County. Under New Jersey state law a public entity cannot be held vicariously liable for the willful actions of its employees. The individual IIED claims were, however, allowed to stand.  

On January 20, 2023, the court set a 60-day administrative termination deadline for the case pending the consummation of an agreed upon settlement.  The plaintiff requested an additional 30 days filing time on March 15, 2023 and was granted it. Dismissal papers for the case were given a deadline of April 20, 2023.
