On October 10, 2012, a child with autism and Attention Deficit/Hyperactivity Disorder (ADHD) and his parents sued the Douglas County School District Re 1 in the United States District Court for the District of Colorado. The complaint alleged that the School District’s proposed individualized education program (IEP) violated the Individuals With Disabilities Act (IDEA), 20 U.S.C. § 1401(3), and Colorado’s Exceptional Children’s Educational Act (ECEA), Colo. Rev. Stat. § 22-20-103(5)(a)(I) by failing to provide the child free appropriate public education (FAPE).

The plaintiff child was enrolled at a school in the defendant school district and qualified for special education services under IDEA. The plaintiff alleges that, when he was in second grade his IEP was designed to manage his behavioral problems, not to educate him. After the school failed to conduct a behavioral assessment, develop supports, or develop an appropriate behavioral intervention plan (BIP), plaintiff was enrolled in a private school. Plaintiff’ parents requested that the defendant school district pay the costs of the private education, and the school district refused.

On February 21, 2012, plaintiff’s parents filed a due process complaint with the Colorado Department of Education and the School District’s Special Education Director pursuant to the dispute resolution procedures set forth in the IDEA. Following a due process hearing, the ALJ issued her Agency Decision on July 9, 2012, finding that the School District’s conduct did not amount to substantive denial of FAPE, even though the District failed to properly document or report plaintiff’s progress. The ALJ also held that the District failed to perform a functional behavioral assessment either before or after it drafted a BIP, but these component are not required for an IEP.

The October 10, 2012 complaint sought to have the District Court reverse the ALJ’s Agency Decision, order the School District to reimburse the parents for private education, order that the District’s proposed IEP failed to provide the plaintiff FAPE, and award attorney’s fees.

On September 15, 2014, Judge Lewis T. Babcock affirmed the Administrative Court holding in favor of the Defendant. The Court held that plaintiff did not meet the burden of proof that he was denied FAPE. Specifically, the plaintiff failed to show that the IEPs were not reasonably calculated, and evidence suggested that the District did keep some record of the plaintiff’s progress, was addressing plaintiff’s behavioral issues, and had been developing a new BIP when he withdrew from the District. 

On October 9, 2014, plaintiff appealed the District Court’s decision to the Tenth Circuit Court of Appeals. Circuit Judge Timothy Tymkovich affirmed the District Court holding on August 25, 2015. The Tenth Circuit held that the gaps in reporting student's progress to plaintiff’s parents did not deprive parents meaningful participation in the child's education, the District was not required to provide a BIP absent disciplinary change in the student’s placement, and plaintiff’s IEP was not substantively inadequate. The plaintiffs petitioned for rehearing en banc in the Tenth Circuit on September 2, 2015. The Court denied this petition on a few weeks later, on September 24.

Plaintiffs appealed to the Supreme Court of the United States and submitted a petition for writ of certiorari in December 2015. The Supreme Court granted cert on September 29, 2016. The parties argued the case before the Supreme Court on January 11, 2017.

On March 22, 2017, the Supreme Court issued a unanimous decision to vacate the judgments of the Tenth Circuit and the District Court and remanded the case. Chief Justice John Roberts delivered the opinion, holding that under the Individuals with Disabilities Education Act (IDEA), schools are required to provide students with an education “reasonably calculated to enable a child to make progress appropriate in light of the child's circumstances.” The Court rejected the “merely more than de minimis” test applied by the Tenth Circuit. The Tenth Circuit Court of Appeals published an order vacating its decision from August 25, 2015 and remanded the case to the District Court.

On remand, District Court Judge Lewis T. Babcock reversed the ALJ’s Agency Decision and held that plaintiff was entitled to reimbursement of their private school placement from the defendant District and attorney’s fees, on February 12, 2018. The court held that, in light of the new standard, the IEP offered to plaintiff by the District in this case was insufficient to create an educational plan that was reasonably calculated to enable Petitioner to make progress, even in light of his unique circumstances, based on the continued pattern of unambitious goals and objectives of his prior IEPs. 

The School District filed an appeal to the Tenth Circuit on March 15, 2018. However, Judge Tymkovich of the Tenth Circuit dismissed the appeal for lack of jurisdiction on April 5, 2018. Specifically, he found that the district court's decision was not final because it had not yet determined the amount of damages.

Plaintiffs filed a notice of settlement on April 19, 2018 explaining that the parties reached an agreement regarding the amount of reimbursement and attorney fees and costs owed by the School District. Although the Clearinghouse not able to find a copy of the settlement agreement, an article published by the Denver Post reported that the School District paid plaintiffs $1.32 million. The District Court granted the parties’ joint stipulation for dismissal with prejudice on May 8, 2018.
