This is a lawsuit brought by transgender adolescents and their parents challenging Florida's ban on medical care for transgender minors (Board of Medicine, Rule 64B8-9.019, Fla. Admin. Code; and Board of Osteopathic Medicine, Rule 64B15-14.014, Fla. Admin. Code). The challenged bans prohibited the use of puberty blockers to stop or delay normal puberty as well as the use of hormones or hormone antagonists in order to affirm a person's perception of his or her sex if that perception was inconsistent with natal sex, rendering violation a crime and grounds for terminating a healthcare practitioner's medical license. 

On March 23, 2023, plaintiffs filed this lawsuit in the U.S. District Court for the Northern District of Florida, alleging that the bans violated the due process rights of parent-plaintiffs to make medical decisions to ensure the health and wellbeing of their children and to seek and obtain effective medical treatment for their children. They further asserted that the bans violated equal protection by banning essential medical treatment to the adolescent-plaintiffs because they were transgender. The suit named as defendants Florida's Surgeon General, the Florida Board of Medicine and individual members in their official capacities, and the Florida Board of Osteopathic Medicine and individual members in their official capacities.  The plaintiffs, represented by Southern Legal Counsel, the National Center for Lesbian Rights, Human Rights Campaign Foundation, and GLBTQ Legal Advocates and Defenders, sought declaratory and injunctive relief, including enjoining enforcement of the bans, as well as attorneys' fees and costs. The case was assigned to District Judge Robert L. Hinkle. 

The parent-plaintiffs filed an amended complaint on April 24, 2023.  Along with the amended complaint, three of the parent-plaintiffs filed a motion for preliminary relief, asserting that their children would suffer immediate and irreparable harm as the result of being unable to obtain medically necessary and time-sensitive care. 

On May 18, 2023, the plaintiffs filed a second amended complaint, adding the state Attorney General as well as twenty individual state attorneys as defendants. The second amended complaint also incorporated challenges to Senate Bill 254, a transgender healthcare ban which went into effect on May 17, 2023. This bill criminalized doctors for providing gender-affirming care to minors, gave non-supportive parents the upper hand in child custody disputes over transgender minors, and imposed new restrictions on gender-affirming care for adults, including onerous written consent procedures and a requirement that all care must be provided by an in-person physician. On May 31st, the Attorney General filed a motion to dismiss the case against her, asserting that she was an inappropriate defendant because she had no authority to enforce and no other involvement with the challenged bans.

On June 6, 2023, the court issued an order granting plaintiffs' request for a preliminary injunction and enjoining enforcement of the bans against transgender children and their parents in Florida. 676 F.Supp.3d 1205. The court noted that the bans prohibited transgender minors from receiving specific kinds of widely accepted care and prohibited doctors from providing such care. Acknowledging that "gender identity is real," the court explained that "the overwhelming weight of medical authority support[ed] treatment of transgender patients" in appropriate circumstances with the GnRH agonists and cross-sex hormones prohibited under the challenged bans. Assessing plaintiffs' due process challenge, the court found "that the plaintiffs are likely to succeed on their claim that they have obtained appropriate medical care for their children to this point, that qualified professionals have properly evaluated the children's medical conditions and needs in accordance with the well-established standards of care, and that the plaintiffs and their children, in consultation with their treating professionals, have determined that the benefits of treatment . . . will outweigh the risks." As to the equal protection claim, the court held that intermediate scrutiny applied to the alleged differential treatment on the basis of sex and transgender status. Applying intermediate scrutiny, the court found that the state's decision to ban the treatments at issue was not rationally related to a legitimate state interest, because "dissuading a person from conforming to the person’s gender identity rather than to the person’s natal sex," a substantial motivating factor for the bans, "is not a legitimate state interest." Ultimately, the court explained, state action motivated by purposeful discrimination violates the Equal Protection Clause.  

Moreover, the court held, because the state could not properly prohibit the treatment at issue, the plaintiffs were likely to prevail on their claim that the bans violated their right to control their children’s medical care.  Because plaintiffs were likely to prevail on the merits, and because the challenged bans would cause irreparable harm to their children but would cause defendants no harm, the court granted the preliminary injunction against the Surgeon General, the members of the Florida Board of Medicine and the Florida Board of Osteopathic Medicine, and the State Attorneys. The injunction did not apply with respect to the Attorney General, pending a ruling on her motion to dismiss, nor to the relevant boards themselves as agencies of the state. Pursuant to the terms of the injunction, the defendants were not to enforce the challenged bans against the three plaintiffs who had sought the injunction.

On June 14, 2023, the parent-plaintiffs voluntarily dismissed the Attorney General and on June 15th the court denied the Attorney General’s motion to dismiss as moot and dismissed her as a defendant. The parent-plaintiffs and 19 of the 20 State Attorneys then reached a stipulated dismissal agreement on June 19, 2023. Under the agreement, the State Attorneys would be dismissed as defendants on the condition that they abide by the preliminary injunction as long as it remained in effect, abide by any future injunctions granted against the remaining defendants, and agree not to enforce the transgender medical bans. The court granted the dismissal on June 22, 2023, after which the State Attorney for the Fifth Judicial Circuit of Florida was the only remaining State Attorney defendant in this case.

The remaining defendants appealed the district court’s order granting a preliminary injunction to the Eleventh Circuit Court of Appeals on June 27, 2023.

Meanwhile, in the district court, the plaintiffs filed a second motion for preliminary injunction on July 24, 2023, seeking to enjoin the defendants from enforcing the restrictions imposed on transgender adults in Senate Bill 254. Plaintiffs argued that the burdens the bill imposed on transgender adults meant that transgender adults could not receive timely care, or in some cases, any care at all. On July 27, 2023, with leave from the court, the plaintiffs also filed a third amended complaint, which joined a group of transgender adults, who had all been diagnosed with gender dysphoria and received ongoing transition-related care, as plaintiffs in the case. On July 31, 2023, plaintiffs—including the parent-plaintiffs and the transgender adult plaintiffs—filed a motion for class certification. The district court heard oral argument for both the second motion for preliminary injunction and the motion for class certification on September 1, 2023.

On September 11, 2023, the district court denied the plaintiffs’ second motion for preliminary injunction. 2023 WL 8271765. The court found that the plaintiffs had not shown a substantial likelihood of success on their merits of the case and failed to show that they would suffer substantial injury should Senate Bill 254 be enforced against the adult plaintiffs. Specifically, the court noted that unlike with the minor plaintiffs, Senate Bill 254 did not prohibit the adult plaintiffs from receiving gender-affirming care. Although the adult plaintiffs could not continue to receive care from their current providers, the court determined that they would likely be able to receive care from other providers. 

Furthermore, the district court found that the plaintiffs were less likely to succeed on the merits of their claim following a decision issued by the Eleventh Circuit on August 21, 2023, in Eknes-Tucker v. Ivey. 80 F.4th 1205. In that case, which challenged similar gender-affirming care bans for minors in Alabama, the Eleventh Circuit found that the plaintiffs did not demonstrate the existence of a constitutional right to treat one’s children with transitioning medications and did not show that the challenged law in Alabama created a sex-based classification. The Eleventh Circuit held in Eknes-Tucker that the district court should have applied rational basis review and thus abused its discretion by evaluating the law under strict scrutiny. Based on this guidance from the Eleventh Circuit, the district court in this case denied the plaintiffs' second motion for preliminary injunction. The preliminary injunction that the district court granted on June 6, 2023, remained in effect pending the Eleventh Circuit’s decision on the appeal.

The district court then granted the plaintiffs’ motion for class certification on October 18, 2023, certifying two classes and one subclass. 2023 WL 8271764. The first class consisted of “all transgender adults in Florida who seek gender-affirming treatment with puberty blockers, cross-sex hormones, or surgery. The second class consisted of “all transgender minors in Florida who seek gender-affirming treatment with puberty-blockers or cross-sex hormones and their parents.” Finally, the subclass, which is a subset of the second class, consisted of “all transgender minors in Florida who seek but are prohibited by state law from obtaining gender-affirming treatment with puberty blockers or cross-sex hormones and their parents.” The order also specified that transgender individuals—either minors or adults—need not be diagnosed with gender dysphoria to be class members.

A three-day bench trial in the district court began on December 13, 2023. The court issued its opinion on the merits on June 11, 2014, holding that the plaintiffs were entitled to classwide declaratory and injunctive relief. 2024 WL 2947123. Specifically, the court found Florida’s statute and rules banning gender-affirming care for transgender minors to be unconstitutional as to individuals who have reached or passed the initial stages of puberty (specifically, Tanner stage II). Moreover, the court also held that while some of the restrictions imposed on how gender-affirming care can be provided when not banned were constitutional many others were not. Specifically, the court struck down the following restrictions:

  • excluding professionals other than physicians from participating in gender-affirming care; 
  • prohibiting APRNs from treating adults; 
  • requiring annual x-rays and DEXA scans without regard to an individual patient’s circumstances; 
  • allowing only psychiatrists or psychologists, not other licensed mental health professionals, to conduct the required annual assessments; 
  • requiring follow-up care and labs more frequently than medically indicated; and 
  • requiring patients to sign consent forms that include “false and misleading statements, address treatments the patient will not receive, are in some respects incomprehensible, and interfere with the physician-patient relationship and an appropriate informed-consent process.”

The court entered a permanent injunction enjoining the Surgeon General, the members of the Florida Board of Medicine and the Florida Board of Osteopathic Medicine, and the State Attorney for the Fifth Judicial Circuit of Florida from taking any steps to enforce any of the statutes or rules held to be unconstitutional. The court officially dismissed all claims against the medical boards citing Eleventh Amendment immunity.


In conducting its analysis, the district court found four grounds on which a heightened standard of review under the equal protection clause could be applied to the bans. Specifically, “line-drawing based on sex; line-drawing based on transgender status or gender nonconformity; Carolene Products; and actual animus against transgenders.” The Eknes-Tucker decision foreclosed the application of heightened scrutiny on either of the first two of these grounds–sex and gender nonconformity. The district court concluded that while the Eknes-Tucker opinion did not specifically address the Carolene Products standard, it could be read to foreclose heightened scrutiny on that ground as well. That left, in the court’s view, actual animus as the sole remaining ground on which heightened scrutiny could apply. In its fact-finding role, the court found “substantial evidence of animus in the adoption of the statute and rules at issue here,” which, in its view, justified the application of an intermediate scrutiny standard of review.


The defendants appealed the district court’s decision to the Eleventh Circuit on June 18, 2024. With the filing of an appeal on the district court’s merits opinion, the defendants filed a motion on July 2, 2024, voluntarily dismissing their still-pending June 2023 motion for a stay of the preliminary injunction. The Eleventh Circuit granted the motion for dismissal on July 8, 2024.


The defendants then filed on July 17, 2024, a motion for a stay of the district court’s decision pending appeal. The matter of the stay came before a three-judge panel consisting of Circuit Judges Charles R. Wilson, Britt Grant, and Robert J. Luck. In a 2-1 decision dated August 26, 2024, Judges Grant and Luck granted the defendants’ motion for a stay. 2024 WL 4132455. In their opinion, the judges held that the district court misapplied the presumption that the legislature acted in good faith and, because of that, likely misapplied an intermediate scrutiny standard when rational basis review was all that was required. The judges also found that the other stay factors weighed in the defendants’ favor. In his dissent, Judge Wilson defended the district court’s handling of the presumption of legislative good faith and the decision to apply intermediate scrutiny, concluding that “given the evidence of transgender animus [in the record]” the defendants had not made a strong enough showing of likely success on the merits. The plaintiffs filed a motion for reconsideration on September 3, 2024, which was denied by the same 2-1 vote on October 3, 2024.


This case remains ongoing with oral argument in the appeal scheduled for the week of January 13, 2025.
