This putative class-action lawsuit on behalf of more than 5,800 youths was filed in the U.S. District Court for the Central District of California on May 25, 2023 against the governor of California, the California Department of Social Services ("CDSS"), San Bernadino County, its Board of Supervisors, and the San Bernardino County Children and Family Services ("CFS"). The complaint alleged that CFS failed to protect those under its care. The plaintiffs, represented by A Better Childhood and private counsel, sued under 42 USC § 1983, alleging violations of substantive due process rights (under the Fourteenth Amendment), and the right to family association (under the First and Ninth Amendments). They also brought claims under the Adoption Assistance and Child Welfare Act, the Americans with Disabilities Act, the Rehabilitation Act, and California law. The plaintiffs sought declaratory and injunctive relief, as well as attorneys' fees. District Judge Maame Ewusi-Mensah Frimpong was assigned to the case. 

In December 2022, the San Bernardino Civil Grand Jury tasked with investigating CFS determined that the San Bernardino child welfare system is “too broken to fix” and should be “abolished.” According to the complaint, CFS has failed to meet its affirmative duties under United States and California Constitutions and federal and state laws to provide foster children with necessary services to ensure their wellbeing. The putative class included all children for whom CFS has or will have legal responsibility and who are or will be in CFS’s legal and physical custody; it also included a subclass of all children who are or will be in CFS’s custody and have physical, cognitive, and/or psychiatric disabilities.

The complaint alleged that CFS did not adequately vet foster homes, monitor child placements with comprehensive home visits, provide timely health or dental assessments, or place foster children in permanent placements. CFS also had limited short-term emergency placements, leaving children in care to sleep on office floors — which lacked appropriate beds, bathrooms and kitchens — for days before finding appropriate placements. In addition, the plaintiffs alleged that CFS allowed caseworkers to oversee an inordinate number of caseloads and did not provide effective services to children with disabilities. Due to these deficiencies, the complaint alleged that CFS was leaving children at risk of substantial harm. 

On October 9, 2023, various defendants filed motions to dismiss for lack of subject matter jurisdiction and/or failure to state a claim. On September 30, 2024, the Court largely denied the motions, though it dismissed some claims against individual defendants, including all claims against the Governor of California and against some individual officials (for failure to state a claim), § 1983 claims against redundant County defendants, and § 1983 claims against CDSS (based on sovereign immunity). 2024 WL 4354697.

Subsequently, San Bernardino County asked the court to allow an immediate interlocutory appeal on the denial of its motion to dismiss. Specifically, the County argued that the court should abstain from hearing this case under the Younger doctrine because there were ongoing related juvenile court actions. The court denied the motion for interlocutory appeal on February 12, 2025.

The case is ongoing as of March 3, 2025.
