This is a lawsuit alleging racially discriminatory treatment of customers at Sesame Place, an amusement park operated by SeaWorld. This is a lawsuit alleging racially discriminatory treatment of customers at Sesame Place, an amusement park operated by SeaWorld.

On July 27, 2022, a private African-American plaintiff, individually and on behalf of a minor, and on behalf of a class of similarly situated individuals (collectively, “Burns”), represented by private counsel, sued SeaWorld Parks & Entertainment, Inc, Sesame Place Philadelphia, SeaWorld Parks & Entertainment LLC, and four private defendants (collectively, “SeaWorld”) in the United States District Court for the Eastern District of Pennsylvania. The plaintiff bought two tickets to Sesame Place Philadelphia, owned and operated by SeaWorld Parks & Entertainment, which included a “meet-and-greet” with SeaWorld’s costume character performers. According to the plaintiff, the costume characters interacted with the white customers but refused to engage with them and ignored all African-American guests in attendance. The plaintiff alleged that this refusal constituted racial discrimination in violation of Section 1981 of the Civil Rights Act of 1886 (“Section 1981”), and breach of contract and negligence under Pennsylvania common law. Burns sought class certification; declaratory and injunctive relief requiring SeaWorld to implement rigorous anti-discrimination training, educational, and screening policies for its employees; and compensatory, punitive, actual, and statutory damages totaling $25,000,000. This case was assigned to District Judge Wendy Beetlestone and Magistrate Judge Richard A. Lloret.

On September 28, 2022, Burns filed an amended complaint to include seven additional named plaintiffs, and to bring this suit on behalf of 89 families involving 125 children. This new complaint maintained the Section 1981 and negligence claims, but no longer included the break of contract claim. Lastly, this new complaint increased the damages amount to $50,000,000.

On November 2, 2022, SeaWorld filed a motion to dismiss for failure to state a claim and for lack of jurisdiction. SeaWorld argued that the admission ticket was not a contract that entitled customers to personal interactions with the costumed character, but instead was a revocable license. Second, Burns did not allege that the costume characters treated them differently. Third, Burns negligence claim should fail because Burns failed to identify any applicable legal duty and made only conclusory allegations about breach without providing factual support. Lastly, SeaWorld argued that because Burns had no intention of ever returning to Sesame Place, they were not likely to be injured again. Thus, Burns had no standing and the request for injunctive relief should be dismissed accordingly. 

On June 5, 2023, the court granted in part and denied in part SeaWorld’s motion to dismiss. Judge Beedlestone found that the Section 1981 claim survived because Burns adequately alleged that the admission ticket did give some contractual rights and that their contract interest was impaired. Regarding the negligence claim, the court dismissed with prejudice the negligent hiring and negligent training theories, dismissed without prejudice the negligent supervision claim, but kept the negligence per se theory because Burns adequately alleged that Section 1981 applied to SeaWorld’s conduct, that SeaWorld violated Section 1981, and that this violation caused Burns’ injuries. Lastly, the court found that Burns could seek injunctive relief because one of the named plaintiffs bought season passes that were not expired at the time of this suit, so there was sufficient standing. 

On September 8, 2023, a special master was appointed in this case, who submitted reports and recommendations to the court throughout the duration of this case. 

On November 27, 2023, Burns filed a motion to certify a class for all African-American or Hispanic persons who, since July 27, 2018, either directly or as a third-party beneficiary, entered into contracts with SeaWorld by purchasing admission tickets into Sesame Place Philadelphia. 

On December 18, 2023, SeaWorld filed a motion for summary judgment. First, SeaWorld argued that under Pennsylvania Human Relations Act, any claims for race discrimination at a place of public accommodations must be brought in front of the Pennsylvania Human Relations Commission, and not as a common law claim in court. None of the named plaintiffs filed a complaint with the proper authority, thus this court was precluded from deciding the negligence per se claim. Second, SeaWorld confirmed during discovery that none of the plaintiffs had any concrete plans to return to Sesame Place so none of them had injunctive relief standing. Third, Burns failed to show that the costumed characters refused to interact with them for a discriminatory reason so there was no discriminatory intent as required for their Section 1981 claim. Lastly, SeaWorld argued that Burns cannot show any violation of a contractual right, because the right not to be discriminated against is provided by state and federal law, and not by the contract at issue here.

On February 5, 2024, Burns filed a motion to file a second amended complaint. Burns claimed that discovery revealed additional facts that would allow them to re-plead their negligent supervision of SeaWorld employees. Additionally, discovery revealed discriminatory practices by SeaWorld employees in situations other than costume character interactions with patrons of color, and thus sought to amend the class definition.

On March 8, 2024, the court granted adding the negligent supervision claim, but denied the claim regarding behavior by employees not involved in performing as costumed characters.

On April 15, 2024, the court denied certifying the class because Burns did not carry their burden of proving numerosity, cohesiveness, or that their proposed class was appropriate for certification.

On April 17, 2024, Judge Beetlestone granted in part and denied in part SeaWorld’s motion for summary judgment. The court found that one of the private plaintiffs had a bona fide intention to return to Sesame Place, so Burns continued to have standing to seek injunctive relief. The court granted summary judgment in whole or in part for each of the private plaintiffs’ Section 1981 claims based on whether the plaintiff could cast doubt on SeaWorld’s proffered nondiscriminatory explanation for its employee’s conduct. Lastly, the court granted summary judgment on the negligent supervision claim because no rational factfinder could conclude on this record that any Sesame Place employee was acting outside the scope of their employment when any alleged discrimination took place. 

On May 1, 2024, one of the private plaintiffs filed a motion for reconsideration because the court allegedly dismissed all their claims based on a wrong understanding of the facts because the court overlooked a video that provided evidence their family was treated discriminatorily. On May 2, the court granted the motion and reinstated plaintiffs as party to this case.

On May 6, 2024, the jury trial began. On September 4, 2024, SeaWorld filed a motion for sanctions. The Clearinghouse does not have access to this motion at this time.

On September 18, 2024, the jury found in favor of SeaWorld. 

On September 24, 2024, the court denied SeaWorld’s motion for sanctions. Burns argued that while each of the private plaintiffs presented evidence establishing prima facie cases of racial discrimination, SeaWorld failed to produce any direct evidence about the state of mind of the employees who were in the character costumes when the alleged discrimination happened, which taken as true, would permit the conclusion that there was a nondiscriminatory reason for the lack of interaction between the child plaintiffs and the costumed character.

On October 16, 2024, Burns filed a motion for judgment as a matter of law. The Clearinghouse does not have access to this motion at this time.

On October 21, 2024, SeaWorld appealed the denial of their motion for sanctions to the Third Circuit of Appeals. On October 23, 2024, the Appeals Court stayed this appeal until after the motion for judgment as a matter of law was decided.

On January 17, 2025, the court denied Burns’ motion for judgment of matter of law. Concerning the Section 1981 claim, the court found that SeaWorld produced sufficient evidence from which a jury could reasonably find that SeaWorld did not violate Section 1981 by discriminating against Burns on the basis of race.

On April 3, 2025, one of the private parties and SeaWorld entered into a joint dismissal with prejudice.

This case is ongoing as of April 17, 2025.
