This case involves allegations of excessive force and conditions of confinement amounting to punishment, experienced by four pre-trial detainees. This case involves allegations of excessive force and conditions of confinement amounting to punishment, experienced by four pre-trial detainees.

The original complaint was filed on May 24, 2021, in the U.S. District Court for the Eastern District of Missouri by three pre-trial detainees at City Justice Center (“CJC”). (A final amended complaint, naming all four plaintiffs, was filed on June 10, 2022.) All plaintiffs were detained at the CJC. The defendants in this lawsuit included the City of St. Louis, as well as several correctional officers. Plaintiffs were represented by various public interest organizations, including the Macarthur Justice Center and ArchCity Defenders.

In the initial complaint, plaintiffs sued under 42 U.S.C. § 1983, alleging that various correctional officers had violated the 14th Amendment by using excessive force and imposing conditions of confinement amounting to punishment. These claims arose from excessive use of chemical agents, like mace, and routine, lengthy water shut-offs. Plaintiffs sought declaratory and injunctive relief, compensatory and punitive damages, costs and attorneys’ fees, and any other additional relief that court found appropriate. (The final amended complaint included all prior claims, added another plaintiff, and asserted individual and class action claims for violations of the Americans with Disabilities Act (“ADA”), alleging that the defendants did not take into account the danger of using chemical agents on incarcerated individuals with certain disabilities that put them at higher risk of harm.) The case was assigned to District Judge Jean C. Hamilton.

Specifically, plaintiffs alleged there was a “widespread pattern” at the CJC of using mace to inflict pain and suffering on detainees, including those who were passive, restrained, or confined. Plaintiffs claimed that the use of these chemical agents violated the Department of Corrections' written policy for several reasons: (1) the use was excessive, (2) it was imposed on inmates who did not pose an imminent danger to staff safety, (3) there was no justifiable security reason for the mace, and instead, it was purely punitive, (4) detainees were not given immediate medical treatment and attention, and (5) no use of force reports were filed. Additionally, plaintiffs alleged that CJC staff deprived detainees of water to their cells for extended periods of time for reasons such as talking back or banging on their cell doors.

On July 14, 2021, defendants filed their first motion to dismiss, arguing that plaintiffs alleged only "de minimis" force and failed to show existence of a widespread custom or policy that condoned the use of excessive force. This motion was partially granted by Judge Hamilton on January 13, 2022. The claims against two named defendants - the Acting Commissioner of Corrections and the Superintendent - were dismissed because they were duplicative of the claims against the City, but the rest of the claims remained. 2022 WL 123785.

Defendants filed a motion to sever and bifurcate the charges on January 4, 2022, but the motion was denied on May 19, 2022. 2022 WL 1591792. Specifically, Judge Autrey expressed doubt that the facts would be too confusing for a jury, and indicated that bifurcating the case would cause significant inconvenience.

On March 15, 2022, plaintiffs filed a motion to amend their first amended complaint and submitted the first motion to certify a class and subclass. That same day, Judge Hamilton recused herself from the case due to a conflict of interest, and it was reassigned to Judge Henry E. Autrey. Judge Autrey granted plaintiffs' motion to amend on May 6, 2022, and plaintiffs submitted their second amended complaint. In response, defendants filed another motion to dismiss. On June 10, 2022, plaintiffs filed their third amended complaint, which identified the individual “Doe Defendants” from the prior complaint. Defendants again filed a motion to dismiss.

Following this, the parties engaged in contested discovery. On August 23, 2022, the case was referred to mediation; however, on June 13, 2023, an ADR compliance report was submitted, indicating that, while the parties participated in good faith, they were unable to reach a settlement.

On February 13, 2023, Judge Autrey denied defendants’ motion to dismiss plaintiffs’ third amended complaint. 2023 WL 1963708. The following month, on March 13, Judge Autry denied plaintiff's motion to certify class, finding that plaintiffs failed to satisfy the commonality requirement and did not demonstrate that the proposed class presented common issues capable of class-wide resolution. 2023 WL 2474508. Plaintiffs filed another motion to certify class in April 2023. On May 26, 2023, defendants filed a motion for summary judgment.

On March 30, 2024, Judge Autrey again denied plaintiffs' motion for class certification due to a lack of commonality. 2024 WL 1463708. The following day, Judge Autrey denied the defendants' motion for summary judgment, holding that there were genuine disputes over whether the defendants were protected by qualified immunity, whether they had a custom or policy of constitutional violations, and whether they had violated the ADA. 2024 WL 1467627. Defendants appealed the denial of summary judgment to the Eighth Circuit on April 30, 2024.

In May 2024, Defendants filed a motion to stay the trial pending the appeal. Judge Autry granted this motion on May 21, 2024. The case was screened for oral argument in the Eighth Circuit on December 2, 2024.  As of March 7, 2025, the oral argument date had still not been set, and thus the appeal in the Eighth Circuit remains pending. This case is still ongoing.
