The Idaho legislature passed HB 71, and the governor signed it into law, on April 4, 2023. The law is set to go into effect in January of 2024, and it will prohibit physicians, under felony sanctions, from providing medications or surgical treatments to minors “for the purpose of attempting to alter the appearance of or affirm the child’s perceptions of the child’s sex if that perception is inconsistent with the child’s biological sex.” The law amounts to a total ban on gender-affirming care for transgender and nonbinary minors in Idaho.

Three transgender minors currently receiving gender-affirming care that will be prohibited under HB 71, along with their parents, brought this lawsuit on May 31, 2023. Represented by the ACLU and private counsel, they filed their complaint in the United States District Court for the District of Idaho, bringing claims against the Attorney General of Idaho, the County Prosecuting Attorney for Ada, Idaho, and members of the Idaho Code Commission. Plaintiffs specifically allege that HB 71 violates the equal protection rights of the minor plaintiffs, because HB 71 prohibits gender-affirming care for transgender and nonbinary minors only, and not their cisgender counterparts. They also allege that HB 71 violates parent plaintiffs right to parental autonomy under the due process clause of the Fourteenth Amendment, arguing that it is their fundamental right to seek and follow medical advice as it relates to their minor children. Finally, plaintiffs allege that the publishing of HB 71 would violate due process guaranteed under the Fourteenth Amendment due to lack of fair notice, because to publish HB 71 as part of the Idaho code would induce physicians, law enforcement, government actors, etc. to comply with a law that is unconstitutional. Plaintiffs seek declaratory relief stating HB 71 violates their equal protection and due process rights under the Fourteenth Amendment and preliminary and permanent injunctive relief enjoining defendants from enforcing HB 71 or publishing it in the Idaho code without clear notice that the provision is unconstitutional.

This case was initially assigned to Magistrate Judge Candy W. Dale, but because not all parties consented to magistrate jurisdiction, this case was reassigned to District Judge B. Lynn Winmill on August 14, 2023.

On July 21, 2023, plaintiffs filed a motion for preliminary injunction, asking the court to enjoin HB 71 from going into effect as scheduled in January of 2024. Twenty-one medical and mental health organizations throughout the United States filed an amicus brief with the court on July 25, 2023 in support of plaintiffs’ motion for preliminary injunction. The amicus brief describes the relevant treatment guidelines of transgender and nonbinary minors experiencing gender dysphoria and the scientific evidence supporting the gender-affirming care that HB 71 bans. The court admitted the amicus brief on August 1, 2023.

Defendants opposed plaintiffs’ motion for preliminary injunction on September 5, 2023, and on the same day filed a motion to dismiss. The Attorney General and Code Commission defendants argued that HB 71 does not discriminate on the basis of sex because it “applies to both males and females the same” and is better understood as a law that targets specific medial intervention for minors. Furthermore, defendants argued that HB 71 does not discriminate on the basis of transgender status because it regulates medical and surgical treatments for gender dysphoria, not for transgender patients. Defendants also refuted parent plaintiffs’ due process claim, arguing that what parents do have a due process right to seek medical treatment for their minor children, they have no constitutional right to seek “experimental and harmful treatments” which HB 71 bans. Finally, defendants argued that even if the court found plaintiffs to be entitled to preliminary relief, an injunction enjoining defendants from publishing and enforcing the law statewide was too broad and inappropriate, and plaintiffs instead should only be entitled to individual preliminary relief. The County Prosecuting Attorney for Ada, Idaho filed a separate motion to dismiss on the same day, arguing that she should not be party to the case because none of plaintiffs’ allegations are directed specifically against Ada, Idaho.

The district court heard oral argument regarding plaintiffs’ motion for preliminary injunction and defendants’ motions to dismiss on November 6, 2023. On December 26, 2023, Judge Winmill issued an opinion granting plaintiffs’ motion for preliminary injunction and granting the Idaho Code Commission defendants’ motion to dismiss, but denying all other defendants’ motions to dismiss. 2023 WL 8935065.

Regarding plaintiffs’ motion for preliminary injunction, the court first determined that HB 71 classifies on the basis of transgender identity. The court reasoned that to agree with the defendants’ contention that HB 71 simply regulates a treatment for a particular diagnosis—gender dysphoria—would be “like saying that classifying on the basis of grey hair doesn’t classify on the basis of age.” Furthermore, because HB 71 classified on the basis of transgender status, it also necessarily classified on the basis of sex. The court therefore applied heightened scrutiny and found that plaintiffs were likely to succeed on the merits of their equal protection claim. Specifically, the court found that HB 71 bans supposedly dangerous treatments for transgender patients while allowing those same treatments for cisgender patients seeking treatments for conditions other than gender dysphoria. The court also noted that the evidence presented indicated gender-affirming care is helpful and necessary for some adolescents, and that withholding such care can be harmful. Thus, the court found HB 71 unlikely to survive heightened scrutiny. The court also found plaintiffs likely to succeed on their due process claim. The court agreed with plaintiffs’ argument that under the due process clause, parents have a fundamental right to care for their children, which “includes the right to choose a particular medical treatment, in consultation with their healthcare provider, that is generally available and accepted in the medical community.” The court further found that plaintiffs would be at risk of suffering irreparable harm without a preliminary injunction, and that public interest weighed in favor of granting the preliminary injunction. Finally, the court determined that a statewide injunction—rather than one pertaining only to the specific plaintiffs—was the most appropriate remedy for three reasons. First, because the plaintiffs in this case are anonymous, it would be exceedingly difficult to grant a plaintiff-specific injunction without compromising their anonymity. Second, the Ninth Circuit has issued state-wide injunctions of an Idaho law facing similar challenges in the past. Third, issuing a plaintiff-specific injunction would likely lead to a needless and repetitive litigation.

Regarding defendants’ motions to dismiss, having determined that plaintiffs were likely to succeed on the merits of their case, the court denied dismissal of the Attorney General of Idaho and the County Prosecuting Attorney for Ada, Idaho. However, the court granted the Idaho Code Commission defendants’ motion to dismiss, finding that the code commission had no power to enforce HB 71, and as such is not suable under Ex Parte Young. Therefore, the court dismissed the Idaho Code Commission defendants.

Defendants appealed the decision on the preliminary injunction and then filed a motion to stay the injunction, pending the appeal. On January 31, 2024 the Court ordered that the matter would be stayed pending the Ninth Circuit's resolution of the the Attorney General's pending appeal. The Court specified that the December 26, 2023 preliminary injunction would remain in effect during the stay.

As of February 27, 2024, defendants are enjoined from enforcing HB 71 across the state of Idaho, and this case is ongoing.
