This case is about the right to access gender-affirming medical care while incarcerated. On April 17, 2019, a transgender adult (Plaintiff) brought this lawsuit in the U.S. District Court for the District of Connecticut against Cook County officials and medical providers working for the Connecticut Department of Corrections. This case was presided over by Judge Vanessa L. Bryant. Plaintiff, represented by the ACLU, sued Defendants under 42 U.S. § 1983, alleging the violation of her Eighth Amendment rights and intentional infliction of emotion distress. Plaintiff claimed that the the Defendants' repeated denial of medically necessary treatment for her diagnosed gender dysphoria constituted cruel and unusual punishment under the Eighth Amendment as well as intentional infliction of emotional distress. 

On April 14, 2022, Defendants filed a motion for summary judgment arguing that Plaintiff did not demonstrate her claim of deliberate indifference to her medical needs. Defendants also claimed they had qualified immunity and the Plaintiff's request for injunctive relief should be denied as she was currently being treated for her gender dysphoria. Additionally, Defendants argued that Plaintiff's claim for intentional infliction of emotional distress was a state-level tort claim, and the court should decline to exercise supplemental jurisdiction as the conduct alleged does not meet the high bar required for this claim.

On the same date, April 14, 2022, Plaintiff also filed a motion for partial summary judgment, arguing there was no genuine dispute of material fact on her claim that the defendants were deliberately indifferent to her medical needs, and this was a violation of her Eighth Amendment rights. 

On September 15, 2023, the court granted Plaintiff's motion for summary judgment and denied Defendant's motion for summary judgment. The court found that the Defendants were deliberately indifferent to Plaintiff's medical needs as it pertained to her gender dysphoria, and determined that the Defendant's had violated Plaintiff's Eighth Amendment Rights. 

On October 10, 2023, the Defendants appealed the denial of their motion for summary judgment on the issue of qualified immunity. 

On July 26, 2024, the Court found that there was an ongoing violation of Plaintiff's Eighth Amendment rights and ordered the Defendants to file a status report updating the court on the efforts made to treat Plaintiff's gender dysphoria in order to determine whether further injunctive relief is necessary. 

At the appellate court level, the Court of Appeals for the Second Circuit heard oral argument on October 28, 2024, and their decision is pending as of February 2025.
