On May 2, 2018, a group of regional Planned Parenthood organizations, represented by WilmerHale, filed a complaint in the U.S. District Court for the District of Columbia against the Secretary of the U.S. Department for Health and Human Services (“HHS”) as well as the Acting Assistant Secretary for the Office of Population Affairs in HHS. The complaint took issue with new Title X regulations put forth by HHS that determine which family planning projects will receive federal funding. The new Funding Opportunity Announcement (FOA) included grantmaking criteria that favored funding programs promoting abstinence, providing onsite primary care, and cooperating with faith-based organizations. The FOA, according to the complaint, omitted any reference to contraception or evidence-based planning. Plaintiffs contended in contravention of Title X’s purpose to ensure access to “a broad range of acceptable and effective medically approved family planning methods” including contraception to all people, and especially low-income women. Thus, the plaintiffs sought declaratory and injunctive relief on grounds that (a) the new FOA, an agency action, was contrary to the law on the Administrative Procedure Act (APA) because the grantmaking criteria were not within any permissible construction of the Title X statute, (b) the FOA was not reasoned because it ran counter to the best available evidence regarding how to promote comprehensive family planning services, thereby being arbitrary and capricious under the APA, and (c) the FOA amounted to a change in the Title X statute without notice and comment rulemaking. The case was assigned to Judge Trevor N. McFadden. 

On May 7, 2018, Judge McFadden ordered a related case — National Family Planning and Reproductive Health Association v. Azar et al. (Docket No. 18-cv-01036) — be consolidated with this case. 

The plaintiffs filed a motion for preliminary injunction on May 8, 2018. The plaintiffs requested the court to (a) enjoin HHS from reviewing Title X grant applications pursuant to the FOA and (2) continue to provide funding to Title X projects currently funded until HHS issues new Title X grants pursuant to a lawful FOA. 

The defendants then filed a motion to dismiss or in the alternative for summary judgment on May 24, 2018. The defendants claimed that the plaintiffs not only could not establish irreparable harm, but that the action was not subject to judicial review for the FOA was not final agency action and HHS’s added priorities and issues are lawful, rational, and justified by the agency. Because HHS has been entrusted with administering Title X, and has exercised that authority to run a successful and effective public health program for years, the defendants claimed that neither the plaintiff nor the court should supplant their opinions over the expertise and authority of the agency. 

The court construed these motions as a cross-motion for summary judgment, and denied the plaintiffs’ motion and granted the defendants’ on July 186, 2018. 316 F.Supp.3d 291. The Judge concluded that the language of the FOA did not bind the final decision-maker and thus was not “final agency action” reviewable under the APA. The Court further found that the criteria was not arbitrary and capricious, nor did it require notice-and-comment since it was procedural in nature rather than legislative. The case was then appealed by the plaintiffs to the D.C. Circuit Court. After the plaintiffs appealed, HHS announced the Title X grants for 2018. In response, the plaintiffs filed an emergency motion for preliminary injunction pending the appeal, though the Court soon denied the motion on July 25, 2018. In November of 2018, HHS issued its FOA for 2019, which significantly revised the challenged FOA provisions. 

On November 19, 2019, the Court of Appeals concluded the appeal to be moot. 942 F.3d 512. The Court noted that no meaningful injunctive relief could be provided to the plaintiffs since the 2018 FOA covered only that cycle and the 2018 grant process had long since concluded. Further, the Court concluded that the changes in the 2019 FOA guidelines further rendered the appeal moot. The focus on abstinence was no longer geared towards minors and adults alike, but to only minors and there were numerous references to contraception in the 2019 FOA. The Court noted that the plaintiffs even acknowledged that “there is no question that what the agency has done here is more moderate on the specific issues that we are concerned about. Thus, due to the moderation of the guidelines and the Court’s belief that the 2018 guidelines would not be used again in the future, the appeal became moot. 

In accordance with the Appellate Court’s decision, the case was vacated and dismissed as moot on Jan. 29, 2020. The case is now closed.
