TEXT ORDER - In December 2022, XAVIER PAGAN filed a Motion to Withdraw from Class Action stating he no longer desired to be a named putative class member 32 . The Court construed the Motion as a stipulation of dismissal under Rule 41(a)(1)(A)(i), and dismissed XAVIER PAGAN as a named putative class member 36 . Now, through the counseled Second Amended Complaint 75, it appears XAVIER PAGAN seeks to reinstate his status as a named putative class member.
