This case involves the use of Facial Recognition Technology (“FRT”) by the Detroit Police Department (“DPD”). The plaintiff, a Black individual, represented by the ACLU of Michigan and the University of Michigan's Civil Rights Litigation Initiative, filed suit in the U.S. District Court for the Eastern District of Michigan on April 13, 2021. The plaintiff sued the City of Detroit (“City”), the DPD Chief, and an individual DPD detective under 42 U.S.C. § 1983. He alleged that the DPD used a blur…

The complaint alleged that the wrongful arrest and imprisonment violated the plaintiff’s Fourth Amendment rights and Michigan state law, and that the City failed to properly train DPD officers about the deficiencies of FRT. Because FRT misidentifies Black people at disproportionately high rates, the plaintiff further alleged that the DPD violated Michigan’s racial discrimination statute. He sought damages, attorneys’ fees, and declaratory and injunctive relief. The case was assigned to District Judge Laurie J. Michelson and Magistrate Judge David R. Grand.

The court dealt with discovery issues from July 2021 until July 2023, and Magistrate Judge Grand held a status conference on July 10, 2023. The plaintiffs additionally filed an amended complaint on June 23, 2023. After several months of negotiations, the parties reached a settlement agreement. The terms of the agreement included changes to the DPD policies and procedures around FRT, including prohibiting arrests based solely on FRT results, an audit of all DPD cases in which FRT was used to obtain an arrest warrant since February 22, 2017, and a DPD training program about FRT required for 4 years from the effective date of the agreement. The parties stipulated to voluntary dismissal, and the court entered its order of dismissal on June 28, 2024, retaining jurisdiction to enforce the agreement for four years.
